Mr. Szarka <br />suggested that that would be up to the City, they were going to try to start the footers on <br />Monday. According to Mr. D. Conway, he said go ahead with the work, as he had no <br />objections. The owners scheduled to have the footers done Monday, they could wait until <br />Tuesday if they need to. Mr. Rymarczyk remarked that Mr. D. Conway would not have told the <br />applicants to start work, as this board has to grant the variance. Mr. Szarka suggested granting <br />the variance subject to Mr. D. Conways' approval. Mr. Engoglia again repeated that Mr. D. <br />Conway could not o.k. Engineering issues, only the engineering department can do that. He <br />again questioned how fast the applicant could dig three wholes for the inspection. Mr. Szarka <br />remarked that he was not sure there is no backhoe on the site. The owners are ready for the <br />pavement to be poured. Mr. Engoglia indicated that he does not think the board can give <br />approval on the basis he has given. The board is willing to meet with the applicant and Mr. D. <br />Conway. Mr. Szarka suggested meeting with himself and Mr. D. Conway the next day. Mr. <br />Rymarczyk informed the applicant that the building commissioner would not be back to work <br />until Monday morning. Mr. Engoglia reminded the applicant that he would still need to expose <br />the sewer for the engineering department. The board members gave their phone numbers to the <br />applicant so they could set up a meeting the following week. Mr. Rymarczyk indicated that it <br />was up to the board as to what they want done. If the board allows the applicant to leave, the <br />floor in that is fine. If the board wants the building department to do an inspection to make sure <br />the foundation and footers are gone, then the building department will require three inspection <br />wholes be dug to verify the work is done. The contractor needs to meet with the Engineering <br />department to verify the storm and sanitary lines have been properly capped. Mr. Szarka <br />suggested only the sanitary was an issue. Mr. Rymarczyk informed Mr. Szarka that the <br />engineering department had not inspected storm or sanitary. The applicant needed to obtain <br />written clarification from the Gas Company indicating that they properly capped off the gas <br />line. Mr. Szarka indicated that the Gas Company did in fact cap the gas line. Mr. Rymarczyk <br />indicated that the City needed something in writing from the C'ras Company for their files. The <br />water line had been properly capped as that letter is in the file. Mr. Engoglia indicated that if <br />there is no foundation walls in place then the slab could stay. Mr. Rymarczyk asked the board <br />to clarify that they are requesting the applicant dig three wholes to verify that the walls have <br />been removed, and if they are removed then the slab can remain in place. Mr. Engoglia <br />answered "yes" the walls can not stay in place, so dig three wholes to show that they have been <br />removed. <br />P. Engoglia motioned to grant Les Szarka of 29691 Lorain Road A variance as amended; to <br />allow footers and floor slab to remain in place if foundation walls have been removed, (which is <br />in violation of section 1365.01). The applicants will dig three wholes so the city can verify that <br />the foundation walls have been removed. The storm and sanitary lines need to be exposed so <br />that the Engineering Department can verify they have been properly capped off. The applicants <br />will submit a letter from the Gas Company indicating that they capped off the gas line. NOTE: <br />In the framing of the motion, Mr. Szarka questioned how far down would they need to dig to <br />verify that the walls are gone. Mr. Rymarczyk suggested digging wholes at three corners down <br />to the floor and then clear the wholes out so the inspector can see that the walls have been <br />removed. The motion was seconded by M. Conway and unanimously approved. Variance <br />Granted. <br />3
