? <br />CITY OF NORTH OLMSTED <br />BOARD OF BUII.,DING CODE APPEALS <br />MINUTES - MARCH 27, 1997 <br />1. ROLL CALL: <br />Chairman Burk called the meeting to order at 7:50 P.M. <br />Present: R. Burk, J. Kazak, and D. Spoerke. <br />Absent: W. Piar and P. Engoglia. <br />Also Present: Assistant Building Commissioner Rymarczyk and Assistant Clerk of <br />Commissions Cornish. <br />II. REVIEW AND CORRECTIONS OF MINLTTES: <br />J. Kazak motioned to approve the minutes of February 27, 1997, seconded by D. Spoerke and <br />unanimously approved. <br />III. COMMUNICATIONS: <br />Chairman Burk noted a correspondence has been received from Larry Hamilton at 5581 Porter <br />Road regarding the hearing scheduled for tonight. Tlie members have read this correspondence. <br />N. HEARINGS: <br />1) Tunberview Homes, P.P. 9235-12-61, vacant lot located between 5581 and 5609 South Porter <br />Road. Request permissiou to coustruct house on a 40 foot lot. Hearing required by Section <br />1305.05(b) to ascertain that proposed construction does not affect drainage of surface water or <br />waste into or over adjoining property or into any public street. Please note: Eugineering <br />Department will review the site plau for drainage. Hearing by the board of zoning appeals will be <br />required. Mr. Curt Dunlap, the builder, presented the proposal. Also present were: Councilinan Nasher; <br />1VIrs. Hamiltou; Mrs. Steiner; Ms. Crraf; Ms. Costa; Mr. & Mrs. Miller; and Ms. Schmidt. <br />Councilman Nasher explained there is an existing flooding problem on Porter Road and many of <br />the residents fear adding another home on Porter will only add to this problem. He noted, <br />although Mr. Diwlap's retention system will reinove the water fi•om lus lot, tlus process will <br />ultimately causes uudo hardship on the surrounding ueighbors that do not have a retention system. <br />Mr. Nasher advised two years ago the city replaced storm pipes and cleaned out some of the <br />ditches in an atteinpt to solve tlus flooding problem. Mr. Duulap explained a back yard drain will <br />be installed and the water swailed either to the backyard drain or the front yard ditch. He believed <br />the flooding problems elsewhere on South Porter should be addressed individually, as he is not <br />respousiUle for controlling the water on other lots. The neighbors clarified the ditch is meant to <br />coutrol the water, but it does not always work that way. Mr. Burk asked Mr. Duulap where the <br />back yard drain would einpty. Mr. I?unlap believed there is a problem with the ditches, however, <br />the water is controlled better by building on the lot than it would be if the lot reinained vacaut. He <br />uoted everyone seems to draiu to tlus vacant lot. Mr. Kazak believed the city should address the <br />draiuage problem in tlus area. Ms. Costa explained she has spent considerable ainount of money <br />in an attempt to eluninate this flooding problem. She elaborated the water drains to the street, but <br />stops and overIlows. Mi•s. Steiner explained, when her drainage tile was redone, she was told <br />they must drain to the back rather than the fiont. 1VIr. Burk questioned where the water drains in
