ROLL CALL: Chairman, Puzzitiello called the meeting to order at 5:30pm. PRESENT: Chairman, Puzzitiello, Board members, M. Conway, and R. Klesta. ABSENT: Board members, D. Spoerke and P. Engoglia. ALSO PRESENT: Building Commissioner, D. Conway, and Assistant Clerk of Commissions, S. Solomon. II. REVIEW AND CORRECTION OF MINUTES: The Board of Building Codes of Appeals ininutes dated Septeinber 21, 2000 have been subinitted for approval. R. Puzzitiello motioned to approve the Building Board of Appeals minutes dated September 21, 2000 as submitted. The motion was seconded by M. Conway and unanimously approved. III. BUIILDING DEPARTMENT REQUESTS: Mariusz OleksX; 6659 Chadbourne Dr. Proposal consists of a fence violation. Applicant built fence with framing facing outward. Violation of 1369.03 (a-1). Chairman Puzzitiello called a11 interested parties forward to review the request. Mr. Oleksy indicated that he was a first time homeowner and he bought this house about two years ago. He saw how lus neighbors had built their fences with the framing outward and thought that it was the appropriate way to build the fence. He had obtained a fence building permit and was surprised when the inspector came and told him that the fence was in violation of the ordinance. At that point he found that the ordinance was changed about a year before he built his fence. Mr. Puzzitiello questioned if Mr. Oleksy owned any of the neighboring parcels. Mr. Oleksy replied no, it is not his property. Mr. Conway indicated that there have been no complaints from aUutting property owners. The complaint they received was that the fence was down in the soil, so it wasn't related to how the fence was constrizcted inside or outside, it was blocking the soil. Mr. Puzzitiello commented that his neighbor had the same fencing condition. Mr. Conway indicated that fence was done under the old ordinance so he is O.K. Mr. Klesta indicated they need to enforce the ordinance. The options would be to flop the fence and put the framing on the inside or the more expensive way to go would be to perimeter it with more wood so the framing would not show on the inside or the outside. The reason they did make that ordinance is because this is unsightly. Even though the neighbors aren't complaining now, whose to say the next neighbor won't complain. Mr. Puzzitiello questioned how Mr. Oleksy planned to correct
