,'6 <br />I i <br />variance is requested: <br />A 13 ft. variance for side yard set back (code requires 15 ft., applicant shows 2 ft.). <br />Which is in violation of Ord. 90-125 section, (1135.02 (I)). <br />Chairman Maloney called all interested parties forward to review the proposal. The oath was <br />administered to David Webb, the owner, came forward to review the proposal. Mr. Webb indicated that <br />he has a narrow lot, which is only 50 ft. wide. If he puts the pool in the middle of the yard it will not <br />leave his children much room to play in the back yard. That is why he wants the pool off to one side. <br />Mr. Maloney indicated that he was concerned with it being only two feet off of the property line because <br />should it ever spring a leak it will a.ffect the neighbors yard. Mr. Webb suggested that the neighbor he is <br />moving it toward has an in-ground pool right on the other side. He has no problem with Mr. Webb <br />building his pool. Mr. Koberna indicated that it shouldn't be a problem as long as he leaves a Iittle room <br />to get in there and maintain the grass. Mr. 1Vlaloney called for a motion. <br />W. Kremzar motioned to grant David Webb of 23888 Lucille Dr. his request for variance (1123.12). <br />Which consists of buildina a pool and that the following variance is granted: <br />A 13 ft. variance for side yard set Uack (code requires 15 ft., applicant shows 2 ft.). Which is in violation <br />of Ord. 90-125 section, (1135.02 (I)). The motion was seconded by T. Koberna and unanimously <br />approved. Variance Granted 5/3/01. <br />3. John Kuhlq 86030 Butternut Ridge Rd. <br />Request for variance (1123.12). The proposal consists of an addition to the existing house. The <br />following variance is requested: <br />A special permit to add to a non-conforming building. <br />Which is in violation of Ord. 90-125 section, (1165.02). <br />Note: Addition must be 15 ft. from garage or garage has to meet fire resistance requirements. <br />Chairman Maloney called all interested parties forward to review the proposal. The oath was <br />administered to Jolul Kuhl, the owner, who came forward to review the proposal. Mr. Kuhl indicated <br />that he has a fairly large lot, which is 75' x 360'. He lives in the historic district and has gone through the <br />Landmarks Commission and they are fine with it. He is building an 18' x 25' addition and he is taking the <br />roof off and adding a second floor. So, he will be building up and not outward. The main concern on the <br />variances was that he needed to be 15 ft. away from the garage. He will be just over 15 ft. with the <br />foundations. Mr. Maloney questioned if the corner of the addition will be 15 ft. away from the house. <br />Mr. ICoberna questioned if he changed the drawing measurements. His plans call for an addition of 20' x <br />27'. Mr. Kuhl indicated that would be the exterior portion and he is still the requu-ed 15 feet away. Mr. <br />1Vlaloney questioned if he planned on adding a deck on to the back of the addition. 1VIr. TKuhl replied yes. <br />Mr. Kremzar questioned how close the edge of the deck would be to the garage. Mr. Kuhl replied <br />approximately 7 or 8 ft. Mr. Maloney called for a motion. <br />T. Koberna motioned to grant Jolul Kuhl of 26030 Butternut Ridge Rd. his request for variance <br />(1123.12). Which consists of an addition to the existing house and that the following variance be <br />granted: A special permit to add to a non-conforming building. Which is in violation of Ord. 90-125 <br />section, (1165.02.). Note: Addition must be 15 ft. from garage or garage has to meet fire resistance <br />requirements. Vaiā¢iance Granted 5/3/01. <br />4.
