Mr. Mertes indicated that it will <br />be for both. Mr. Spalding suggested that he understood the plan was to have the addition for the <br />owner's benefit only. Mr. Hreha questioned if the owner planned on living in the garage. Mr. Mertes <br />indicated that he did not think the owner planned on living in the garage. Mr. Allan remarked that he <br />does not want the addition at all and he is surprised that the variances were granted. He does not feel <br />that the proposal is in the best interest of the city and believes that the structure now is an eye sore and <br />is not needed. Mr. Hreha indicated that he agreed with Mr. Allan. Mr. Spalding indicated that it was <br />the boards understanding in the beginn'ing of this that the owner needed a sunroom for his ailing legs. <br />The board doe not see any benefit to adding a sunroom to a business. Mr. Dubelko reviewed that there <br />is an assumption that when a proposal comes before the Planning Commission that it meets the basic <br />minimums of the zoning code, or if it requires variances that they will be obtained. Mr. Conway <br />brought the proposal before the board indicating the violations of the code and those have received <br />variances. What the board has before them now is a proposal that complies with the code. The boards <br />duties are now to review the proposal (i.e. look at traffic safety, esthetics) and make recommendations <br />to improve the proposal to the extent practicable. Mr. Spalding invited audience members to come <br />forward if they had any questions. Mr. Kilroy indicated that he has looked at the old Gulf gas station <br />since it was placed on the site. The site has been a problem regarding bein? properly maintained from <br />the start. A sunrooin would be a detriment to the neighborhood. The neighborhood is trying to clean <br />the area up and adding to this eye sore is not going to help improve the area. Mr. Mertes reviewed that <br />the addition would not be a glass enclosure it is an addition. Mr. Allan questioned if the garage owner <br />worked on cars ar was it strictly self- serve. Mr. Mertes suggested that the owner still worked on cars. <br />W. Spalding motioned to approve Braulio IZoldan (Roldan's Car Service) of 23055 Lorain Road their <br />proposal, which consists of adding a Sunroom to the existing, structure. The motion was seconded by <br />C. Allan and unanimously denied. Motion Deniecl. The clerk announced that the proposal would go <br />before the Building Zoning and Development board June 12, 2001, at 6:30pm. <br />4. Tops Markets; 26666 Brookpark Rd. Ext. <br />Proposal consists of removing the existing Ames store (104,330-sq. ft.) for new Tops Market & retail <br />vuildings (77,920-sq. ft.). Note: This proposal was tabled at the April 10, 2001 Planning Cominission <br />meeting. <br />Actino, Chairman Spalding called all interested parties forward to review their proposal. Mr. Gerragnoli <br />froin Top's supermarket fi-om New York and Mr. Tomczak with ADA Architects came forward to <br />review the proposal. Mr. Gerragnoli reviewed that at the last meeting the Planning Commission wanted <br />Top's to mee*. with the neighbors to address their concerns, which they have. Mr. Spalding requested <br />that the applicant review first the differences that were made. Mr. Tomczak reviewed that the <br />neighbors were concerned with the entrance of the store being near the north east side of the building <br />so the entrance has moved to the south east side of the building. The truck docks will be facing the <br />Brookpark Road ext. now. The retention drain will be enlarged to handle the increased water amounts <br />from rain. Mounds on both sides of the store will be added as well as Australian pines, which will <br />increase the buffer between he store and neighbors. Mr. Gerragnoli the residents were mainly <br />concerned about the northern side of the property. A row of parking spaces was removed along the <br />northern site and along he northern side of the building there will be green space i.e. grass which will <br />eliminate the truck traffic. The dumpster truck will be once a week twice at the most and the time will <br />be controlled. Deliveries will be made during day hours 8:00am to S:OOpm. Mrs. O'Rourke inquired if <br />the fence had been addressed. Mr. Gerragnoli indicated that there will be a new 8foot board on board <br />fence put up. Mr. Spalding questioned if the fence would be placed on the mounds or at ground level. <br />Mr. Gerragnoli indicated that the new fence will be placed were the existing fence in now.
