The request for variance #6 was withdrawn. Mr. Conway pointed out the fourth variance is for <br />signage. Mr. O'Malley said they can include all the signs in the motion as well and make them all <br />conditioned upon this particular development plan as presented with the restriction that they do not <br />mean 7 separate monument ground signs. It refers to the 6 directional signs that are shown. Mr. <br />Maloney said 2 variances were withdrawn under signage. The 1't and 4th requests were withdrawn. <br />Mr. Maloney said the motion will include variance #2 for 7 ground signs which include 6 directional <br />signs, and variance #3 for a billboard sign, and that all ground signs be removed from the preinises <br />should this project be abandoned. Mr. O'Malley said it could be said that the variances are conditioned <br />upon this development plan application and limited to this plan. <br />J. Maloney made a motion to grant Wendy's Old Fashioned Hamburgers, 3785 Clague Road, its <br />request for variance (1123.12), which consists of a restaurant and sign package, and that the following <br />variances be granted: <br />2. A 16 foot variance for front yard setback of building, (code requires 75 ft., applicant shows 59 ft.), <br />section (1139.07) table. <br />3. A 4 foot 1 inch variance for sideyard setback for parking, (code requires 20 ft., applicant shows 15 <br />ft. 11 inches), section (1139.07) table. <br />4. A 6 foot variance for aisle width at rear (east), (code requires 22 ft, applicant shows 16 ft.), section <br />(1161. Table). <br />5. A variance for a loading zone, (code requires a loading zone, applicant does not show a loading <br />zone), section (1161.13). <br />6. A variance for not installing an irrigation system, (code requires an irrigation system, applicant does <br />not show an irrigation system), section (1139.14). <br />7. A 10.5 foot variance for driveway width, (driveway is currently 30'wide), (code permits 24', <br />applicant shows 34.5 `), section (1161.10 G). <br />Which is in violation of Ord. 90-125 sections (1139.06), (1139.07), (1161 Table), (1161.13), (1139.14) <br />and (1161.10 G). <br />The following variances are requested for the signage: <br />1. A variance for 7 ground signs on a lot, (code permits 1 applicant shows 7), section (1163.26 A). <br />(see note: 1) <br />2. A variance for a billboard sign, (code does not permit, applicant shows 1), section (1163.29). (see <br />note: 2) <br />Note: 1. Includes 6 directional signs. 2. An insert panel on CVS monument sign. <br />Which is in violation of Ord. 90-125 sections, (1163.27 A), (1163.26 B), (1163.29) and (1163.26 A). <br />The motion was seconded by W. Kremzar and unanimously denied. Variances Denied. <br />7). Pana John's/MC Sign; 24753 Lorain Road: WRD 4 <br />Request for variance (1123.12). The proposal consists of signage. <br />The following variances are requested: <br />1. A 6 square foot variance for a wall sign larger than code permits, (code permits 16.5 sq. ft., <br />applicant shows 22.5 sq. ft.), section (1163.24 C). <br />2. A 142.2 square foot variance for maximum sign face area or a building, (code permits 210 sq. ft., <br />applicant shows 344.7 sq. ft), section (1163.24 B). <br />3. A 127.1 square foot variance for maximum sign face are on a lot, (code permits 382.4 sq. ft., <br />applicant shows 509.5 sq. ft.), section (1163.24 A). <br />Which is in violation of Ord. 90-125 section (1163.24 (A) (B) (C)). <br />Chairman Maloney called all interested parties forward to review the request. Mr. Lou Belknap came <br />forward and was sworn in. He explained the current signage for Papa John's. He said they are <br />proposing a smaller sign in terms of square footage. It is smaller because it is a rolled top. They <br />would like to use the national company symbol and they want to stay with the corporate size to go with <br />11
