32 parking spaces. He is concerned about overflow parking. Ms. Obert said the parking has to do with <br />their parcel being considered part of the entire shopping center. If their parcel is considered separately, <br />they would meet parking requirements for a restaurant of their size. Mr. Conway said the board can <br />discuss the numbers that are on the table tonight but if they want different numbers he suggests tabling <br />it. Mr. O'Malley said there were previous variances granted on lot coverage and on parking. The <br />board should take that into consideration as well. It is not just 32 spaces. He said in addition to 60 <br />previous spaces short, they are adding another 32 for a total of 92 spaces short. Mr. Conway said there <br />were several things that have occurred since the first variance was granted. Mr. Todaro explained what <br />is included in their parking counts. Mr. Wilson said their site is currently a Park-N-Ride lot that will <br />be moving. Mr. O'Malley said it has already moved. Ms. Obert and Mr. Wilson reviewed their <br />requests and showed the board members renderings of the signage. Mr. Maloney asked about the <br />variance for more signage than permitted. Ms. Obert said they had to consolidate some of the signage <br />in order to reduce the canopy sign. They compromised with the city but in doing that, they have to <br />include the whole sign instead of just the letters. She added they originally had a wall sign but <br />removed it as part of the variance reduction and now they are requesting a ground sign. It would be <br />the only signage along the shopping center road. Ms. Obert mentioned there was a variance that was <br />missed initially and she explained it deals with the triangle created 35 ft. back from the intersection. <br />Their ground sign would be within the triangle. Mr. Conway asked if they can slide it out of the <br />triangle. Ms. Obert indicated they cannot. Mr. Conway said his concern is visibility and there should <br />be enough visibility for people coming around the bend. He said if someone tries to turn left out of <br />that driveway, there will be some issues and potentially a lawsuit. They should think about it. Mr. <br />Wilson discussed the layout with Mr. Conway while the board members conferred. Mr. Conway said <br />he does not have a particular safety concern with the location of the sign. He does not have a <br />particular problem with the development. He requested the developer be present because the board <br />needs to address the overall situation. He asked if they need to have the developer come back and <br />present a future expansion plan or are they done. This puts the board in an adverse position because <br />they are dealing with an individual person. He does not believe they should approve any further <br />development on this site unless a developer presents a proposal to the board for overall development <br />on the site. Mr. Maloney asked about the size of tracker trailers bringing food onto the site. Ms. Obert <br />reviewed the loading zone. Mr. Wilson indicated they will not receive seini loads because they do <br />short cycle deliveries. They get deliveries about every 2 days. Mrs. Sergi asked if the restaurants all <br />look the same. Mr. Wilson explained none of their facilities are identical. They are going with a <br />corporate design that they feel best suits the lot. Mrs. Sergi asked if they considered having a flat sign <br />on the front which would have eliminated a few variances. Mr. Wilson replied the signage relates to <br />the building design. Ms. Obert indicated the angles have been studied and this is the building <br />Chipotle's felt best addresses the site and the corner element of the site. Mr. O'Malley said it <br />appropriate that the board be enlightened that at the side bar review with Mr. Conway it was disclosed <br />that the additional ground sign that is proposed, but not shown in a rendering, is 9 ft. tall. It is located <br />in with landscaping and near the trash receptacle. Mr. Maloney said it would be variance #6 and it <br />should indicate the sign is approximately 9 ft. tall and is blended in with the landscaping. Mr. <br />O'Malley said the variance is needed because there is a Developers Diversified ground sign for the <br />entire shopping mall not too far from the location of the proposed restaurant. The board is familiar <br />with this issue as it is very common to have the shopping center development come in and have a <br />menu board sign and each individual tenant comes in and wants its own monument sign. Mr. Kremzar <br />asked if they pass the variance for 32 parking spaces would they be changing the ratio again. Mr. <br />Conway said it would be changing it. They would be granting a variance to the ratio they established <br />previously. Ms. Obert said they are keeping it as stated in their request. Mr. Maloney confirmed to the <br />developer that it is 92 parking spaces eliminated. Mr. Todaro indicated that is correct based on the <br />calculations before them. Mr. Maloney said in looking at development they may be confronted with, <br />down the road, they should come in with some type of plan for the other property. Mr. Todaro said he <br />6
