Chairman Maloney called all interested parties forward to review their request. Mr. Faraj the owner and <br />Mr. Paris, the attorney for the applicant each came forward to be sworn in and review the request. 1VIr. <br />Faraj suggested that he did not know he needed a permit to replace his old shed with a new one. Mr. <br />Kremzar questioned what the open ditch was that ran from the back of the home to the shed. Mr. Faraj <br />suggested that the ditch it is for his mint plants. Mr. Maloney questioned if the applicant had any <br />intentions to running utilities to the shed. Mr. Faraj commented that there were no utility lines in the <br />ditch it is only mint plants. Mr. Conway suggested that the lot is an odd size but the applicant has not <br />shown why this large of a shed is required. He has not heard any hardship reason why the variance <br />should be granted. Mr. Faraj suggested that he would like to store his garage tools and snowmobiles. <br />Mr. Paris suggested that the hardship is that the shed is already built and his client did not know he <br />needed a permit to build the shed. His neighbors have not complained about the shed either. Mr. <br />O'Malley suggested that he did not agree with the attorney that the variance should be granted due to the <br />client's lack of the law or the money involved complying to the law. Those issues do not justify a <br />hardship. Mrs. Sergi questioned if the bottom of the shed would be finished as there is an area exposed. <br />Mr. Faraj indicated that he would finish the shed once the permit is granted. <br />J. Konold motioned to grant Ali Faraj of 23476 Carriage Lane his request for variance (1123.12). Which <br />consists of a shed erected in rear yard and that the following variances are granted: <br />1. A 92 square foot variance for a shed larger than code permits (code permits 48 sq. ft., applicant <br />shows 140 sq. ft.), section (1135.02 (d)(1)). (See note #1) <br />2. A 2 foot 4 inch variance for a shed too close to side lot line (code requires 5 ft., applicant shows 2 ft. <br />8 inches), section (1135.02 (d)(4)). <br />3. A 2 foot variance for a shed too close to rear lot line (code requires 10 ft., applicant shows 8 ft.), <br />section (1135.02 (d)(4)). <br />Note: #1 Rear yard area is odd shaped. Averages used to calculate permitted size of shed is 48 square <br />feet. Which is in violation of Ord. 90-125 section (1135.02 (d)(1)), and (1135.02 (d)(4)). J. Maloney <br />seconded the motion. Emil Morad; 5536 Columbia Road; <br />Request for variance (1123.12). The proposal consists of a storage shed built larger than originally <br />approved by the Board of Zoning Appeals on 5/2/02. <br />The following variance is requested: <br />l. A 200 square foot variance for a storage building larger than code permits (code permits 200 sq. ft., <br />applicant shows 400 sq. ft.) <br />Note: Variance for a 16'x20' storage building was originally approved by the Board of Zoning <br />Appeals on 5/2/02. A 20'x20' storage building was erected on this site. <br />Which is in violation of Ord. 90-125 section (1135.02 (d)(1)). <br />Chairman Maloney called all interested parties forward to review their request. Mr. Morad, the owner, <br />Mrs. Morad, the applicant's mother, Mr. Wisniewski, and Mr. Zak neighbors of the applicant each came <br />forward to be sworn in and address the request. Mr. Morad reviewed that they wanted a 20' x 20' shed, <br />but once the plans were submitted to the Building Department, they were informed they were not <br />allowed that size of a shed. New plans were submitted and the variances were granted last month by this <br />board for a 16' x 20' shed. However due to him becoming ill his friend offered to build the shed for <br />him, mixed the two plans up, and built the 20' x 20' shed. Once the stakes were placed for the shed they <br />requested an inspection and were informed one would be made once the shed was completed. Mr. Morad <br />apologized for the mistake and suggested that he could not afford to correct the size of the shed. Mr. <br />Wisniewski suggested that he was present to support Mr. Morad's request as he is trying to help his <br />mother the best he can. His mother fell and now lives with Mr. Morad so they are trying to consolidate <br />5
