wi <br /> <br />CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DTFFERENCE" <br />BOARD OF ZONING APPEALS <br />MINUTES - MAY 2, 2002 <br />7:30 P.M. <br />I. ROLL CALL: <br />Chairman; J. Maloney called the meeting to order at 7:35 p.m. <br />PRESENT: Chairman, J. Maloney Board members; W. Kremzar, T. Kelly, N. Sergi and J. <br />Konold. <br />ALSO PRE5ENT: A.ssistant Law Director, B. O'Malley, Assista,nt building Cbmmissioner; T. <br />Rymarczyk and Clerk of Commissions; D. Rote. II. REVIEVV AND CORREG'TION aF NIINUTES: The Board of Zoning Appeals rninutes of April <br />4, 2002 have been submitted for review. <br />J. Konold motioned to approve the April 4, 2002, Board of Zoning Appeals minutes. The motion <br />was -seconded by W. Kremzar and unanimously approved. <br />Chairman, Maloney indicated_ that .there are 8 cases :requesting 16 variances. Mr. Malaney <br />advised that each board member had viewed the premises involved for each case. Three votes are <br />required for approval. In addition each case will be judged on the physical .situation peculiar to <br />itselt so that in no way is a judgment rendered considered to -be a general policy judgment <br />affecting praperties and like situations elsewhere. . <br />III. BUILDING DEPARTMENT REQUESTS: <br />1. Maureen Loeser4673 Williamstown Dr.; (WRD 1) <br />Request for variance (1123.12). The proposal consists of installing a fence inside setback. <br />The following variances are requested; <br />1. A.16 foat variance for side yard setback on a corner lat (code requires 25 ft., applicant shows 9 <br />ft.), section (1135.02 (fl(1)). <br />2. A 42 inch height variance for erecting a fence higher than 30 inches (cvde perniits 30", <br />applicant shows 72"), section (1135.02 (fl(1)). <br />3. A variance for a fence in,sideyard setback which is under 50% open (code requires 501/o open, <br />applicant shows under 54%), section (1135.02 (f)(1)). <br />Which is in violation of Ord. 90-125 secfion (1135.02 (fl(1)). <br />Chairman Maloney called a11 imerested parties forward to.review their request. Mrs. Loeser came <br />forward to be sworn in and review her request. Mrs. Loeser would like to fence in her yard, <br />which 'is a comer lot. The main rea,son for the fence is for safety, as they wi11 be putting in a pool <br />this summer. Mrs. Sergi questioned if the .area around the fence could be maintained once the <br />fence is in place. Mrs. Loeser felt the neighbor's would -be able to maintain their yard and she <br />hers.. Mr. Maloney questioned what type of fence the applicarrt wanted. Mrs. Loeser indicated <br />that the fence will be a 6-foot bigh shadow box type fence. Mr. Maloney questioned if any of the <br />neighbors objected to the fence. Mrs. Loeser suggested that no neighbors objected to the <br />proposed fence. W. Maloney questioned the distance of the area of fence, which would be <br />angled. Mrs. Loeser indicated that the fence would be in 5 feet from the rear of the praperty line <br />a.s there is an easement. The fence will be angled from the south from corner of the garage to the <br />southeast-proposed fence. The southeast fence along Leenders Lane will be in 10-feet from the <br />sidewalk. The angling of the fence will sta.rt at the basketball hoop wluch is about the halfway <br />mark of the driveway.
