CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARI) OF ZONING APPEALS <br />NIINUTES - NOVEMBER 7, 2002 <br />I. ROLL CALL: Chairman, Maloney called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman, J. Maloney, Board Members W. Kremzar, and T. Kelly J. Konold and N. <br />Sergi. <br />ALSO PRESENT: Assistant Law Director, B. O'Malley, Building Commissioner D. Conway and <br />Clerk of Commissions, D. Rote. <br />II. REVIIEW AND CORRECTION OF MIN-[JTES: <br />The Board of Zoning Appeals minutes of October 3, 2002 have been submitted for review. <br />J. Konold motioned to approve October l, 2002 minutes as submitted. W. Kremzar seconded the <br />motion, which was unanimously approved. <br />Chairman Maloney welcomed a visiting Boy Scout Troop and reviewed that there were 14 cases <br />requesting 27 variances. The Chairman advised that each board member had viewed the premises <br />involved for each case. Three votes are required for approval. In addition each case will be judged <br />on the physical situation peculiar to itself, so that in no way is a judgment rendered considered to be <br />a general policy judgment affecting properties and like situations elsewhere. <br />III. BUII.,DING DEPARTMENT REQUESTS: <br />7ack & Margaret Urban; 5105 Andrus Ave.; <br />Request for variance (1123.12). The proposal consists of building a new garage. <br />The following variances are requested: <br />1. A 5 foot variance for rear setback requirements (code requires 10 ft., applicant shows 5 ft.). <br />2. A 3 foot variance for side setback requirements (code required 5 ft., applicant shows 2 ft.). <br />Note: Previous side and rear variances were granted for opposite corner at Board of Zoning Appeals <br />meeting of 9/5/02. Engineering discovered easements, which were not previously disclosed. New <br />site plan submitted 10/2/02. Downspouts to be installed per Engineering letter dated 10/10/02. <br />Which is in violation of Ord. 90-125 section (1135.02 (c)(2)). <br />Chairman Maloney called all interested parties forward to review their request. Mr. Damico, with <br />Garage Door Company and Mr. & Mrs. Urban each came forward to be sworn in and review the request. <br />Mr. Damico indicated that in September they were before the Board of Zoning Appeals and were <br />granted a rear and side yard variance. However, it was found that there is an easement along the sideline <br />and rear yard line so the plans had to be changed. The garage will be built on the other side of the home <br />and be placed 5 feet from rear yard line and 2 feet off side yard line. The new driveway will include a <br />turnaround. Mr. Kremzar questioned why the garage could not meet the 5-foot sideyard requirements. <br />Mr. Damico suggested that there would not be enough room for the turnaround at 5 feet. Mr. Kremzar <br />questioned how the garage would be maintained. Mr. Damico indicated that there would be vinyl siding <br />and sewer lines would be added so there would be nothing to maintain. Mr. Conway believed that the <br />applicant should place the garage at a 3-foot sideyard setback to be able to maintain the garage. Mr. <br />Konold questioned if the applicant would agree to place the garage 3-feet in from sideyard. Mr. Urban <br />indicated that he could live with the garage being 3-feet from sideyard line. <br />J. Maloney motioned to grant Jack & Margaret Urban of 5105 Andrus Ave. their request for variance <br />(1123.12) as amended. Which consists of building a new garage and that the following variances are <br />granted:
