The proposal consists of re-use of a pole sign.
The following variances are requested:
1. A variance for use of a non-conforming sign which has been abandoned (code does not permit,
applicant shows using a pole sign), section (1163.10 (b)).
2. A variance for change of use of a non-conforming sign (code does not permit, applicant shows
change of use), section (1163.10 (c)).
3. A variance for incomplete information on variance application (code requires complete site plan,
applicant shows incomplete site plan), section (1163.05 (c)).
Note: Pole sign has been abandoned since November 16, 2001.
Which is in violation of Ord. 90-125 sections (1163.10 (b)), (1163.10 (c)), and (1163.05 (c)).
Chairman Maloney called all interested parties forward to review their request. Mr. Beeman, with
Wagner Sign Company and Mr. Schill, with B& G Properties each came forward to be sworn in and
address the request. Mr. Beeman submitted updated drawings to the board members. Mr. Conway
suggested that the sign has been abandoned for more than six months and the board should address the
pole sign. The owner of the property is present so it can be addressed. He has requested that a survey be
made of the land to get the exact dimensions of the lot as it is not clear. Mr. Schill suggested that the
engineer for their company was currently working on that. Mr. O'Malley suggested that this a very large
parcel of land and there is no clarification as to the exact location of the lot lines. This has an abandoned
pole sign, there has been no use for more than six months, and the owners have been asked by the
Building Department to remove the pole sign. Mr. Maloney questioned if the owner has looked at
putting in a ground sign. Mr. Schill suggested that the B.P Station is 5-feet higher than this site so they
need to keep the pole sign. Mr. Beeman suggested that traveling east a ground sign could not be seen
from the road. Mr. Conway suggested that the owner needs to address the site. There are hardships,
however the owner needs to address the entire site as a whole. Board members voiced that the
abandoned pole sign should be brought into compliance. Mr. Kelly suggested denying the request for
the pole sign. Mr. Conway suggested the board table the proposal until the owner address the entire site.
W.
