W. Kremzar motioned to approve Gavril & Veronica Budai of 28406 N. Park Drive their request for <br />variance (1123.12) as amended. Which consists of a new shed and that the following variance is <br />granted: A 16 square foot variance for a shed larger than code permits (code permits 200 sq. ft., <br />applicant shows 216 sq. ft.). The installation of gutters is to be to the Engineering Departments <br />specifications. J. Konold seconded the motion, which was unanimously approved. Variance Granted. <br />6. Howard & Kathleen Dillinger- 28265 Nandina <br />Request for variance (1123.12). The proposal consists of an addition. <br />The following variance is requested: <br />1. An 11 foot variance for a dwelling with less than required front setback (code requires 50 ft., <br />applicant shows 39 ft.) <br />Which is in violation of Ord. 90-125 section (1135.06 (b)). <br />Chairman Maloney called all interested parties forward to review their request. Mr. Dillinger the owner <br />came foreword to be sworn in and address his request. Mr. Dillinger reviewed that he would like a 26' x <br />15' addition on the side of his home. He felt that the home was positioned wrong on the lot when it was <br />built. The back of his home faces the neighbor's driveway. He has access to the neighbor's driveway <br />through his dinning room doors. There is no access to the sideyard of the home, except through the <br />garage. To place the addition on the required side of the home the patio would need to be removed as <br />well as all the windows on that side of the home. The house is a split-level, which makes it hard trying <br />to add on to the home. They have lived in the home for 13 years and his family needs additional space. <br />Mr. Kremzar questioned the size of the garage. Mr. Dillinger indicated that the garage is currently not to <br />today's code. He would like to place the addition in an area that would not require them to go through <br />the garage to have access to the addition. The addition will be placed by the existing family room and <br />dinning room, which has more land on that side of the lot. Mrs. Sergi questioned what trees would need <br />to be removed. Mr. Dillinger indicated that both trees on that side of the home would be removed. W. <br />Conway suggested that he understood the applicant's need for the variances as this is an unusual case the <br />way the home is situated on the lot. <br />W. Kremzar motioned to grant Howard & Kathleen Dillinger of 28265 Nandina their request for <br />variance (1123.12). Which consists of an addition and that the following variance is granted: <br />An 11 foot variance for a dwelling with less than required front setback (code requires 50 ft. applicant <br />shows 39 ft.). Which is in violation of Ord. 90-125 section (1135.06 (b)). T. Kelly seconded the <br />motion. Roll call on the motion: W. Kremzar, T. Kelly, J. Konold and J. Maloney; "Yes" N. Sergi "No". <br />Variance Granted. <br />7. Ali Faraj; 23476 Carriage Lane: <br />Request for variance (1123.12). The proposal consists of a shed erected in rear yard. <br />The following variances are requested: <br />l. A 92 square foot variance for a shed larger than code permits (code permits 48 sq. ft., applicant <br />shows 140 sq. ft.), section (1135.02 (d)(1)). (See note #1) <br />2. A 2 foot 4 inch variance for a shed too close to side lot line (code requires 5 ft., applicant shows 2 ft. <br />8 inches), section (1135.02 (d)(4)). <br />3. A 2 foot variance for a shed too close to rear lot line (code requires 10 ft., applicant shows 8 ft.), <br />section (1135.02 (d)(4)). <br />Note: #1 Rear yard area is odd shaped. Averages used to calculate permitted size of shed is 48 <br />square feet. #2 Shed was erected with no permit. Applicants state they were unaware that a permit <br />was necessary. <br />Which is in violation of Ord. 90-125 section (1135.02 (d)(1)), and (1135.02 (d)(4)). <br />4
