Legal Opinion 2002-06 <br />To David Conway, Building Commissioner <br />from James M. Dubelko, Director of Law <br />Subject: Enforcement of Zoning Regulation Prohibiting Sale of Liquor in Commercial District. <br />Dated: January 25, 2002 <br />permit if it believes that such grounds exist. With respect to the proposed restaurant <br />development at 26670 Lorain Road, City Council, on January 3, 2002, by motion, voted <br />unanimously not to object to the issuance of a liquor permit for this proposed restaurant. <br />I trust that the foregoing Memorandum, confirming the legal advice that I previously gave to <br />you regazding the applicability of Section 1139.01(b)(3)E) of the Zoning Code to the proposed <br />restaurant development at 26770 Lorain Road, will additionally serve the purpose of providing legal <br />guidance to the City and its officials in the matter of future liquor permit applications at other <br />locations in the City's commercial and industrial districts.
