was changed to Mix Use A they still did not have 10-acres. Mr. Dubelko indicated that the City <br />created the lot and approved the lot, which created the non-conforming size of the lot. Therefore, <br />the City can not impose the 10-acre requirement. He reviewed that before 1981 there was only a <br />Single Mixed Use District. In 1981, the City created a second Mixed Use District "A" on the West <br />end of town. The City of North Olmsted has to look at this site and believe that it was lawfully <br />created and a regulation that was subsequently enacted requiring larger acreage for development <br />can not be retro acted upon that lot. Mr. Weber questioned what the acreage of the Briddle Wood <br />Apartments are. Mr. Rymarczyk suggested that he was not sure. Mr. Weber suggested that the <br />Briddle Wood apartment lot size is 6.62 acres which is less then 10=acres but more then 3-acres. <br />Mr. Dubelko indicated that the 1480 issue needed to be taken into consideration as well, because the <br />other side of 1480 is Mixed Use as well. The district itself is more then 10-acres however, with <br />different events that have taken place, i.e. lots being split and 1480 coming through the area it does <br />change things. The City of North Olmsted can not tell a land owner that they can not develop their <br />land for Mixed Use when that is what it is zoned. Mr. Waken read from code 1149.02 regarding <br />traf?ic issues and questioned if a traffic study had been performed. Mr. Koeth indicated that the <br />I'lanning Commission requested a report from the safety department regarding safety issues. The <br />clerk reviewed that only the Fire department and forester had received a copy of the site plans as <br />they were received late Friday afternoon. Mr. Asseff suggested having the City Traffic Engineer <br />submit a report. Mr. Koeth questioned the price of the apartments. Mfr. Gillespie indicated that a <br />one bedroom with den would be between $600.00 to $700.00 a month. There are factors, which <br />will effect the prices such as the surrounding area, current market, and location. Mr. Waken <br />indicated that he believed that the site would be improved by the development however, if the <br />applicant were to cut down the number of units there would not be as many complaints. Mr. <br />Gillespie reviewed that before coming before the board he met with abutting residents and would <br />continue to meet with them to try to make the project the best it can be. He would like to move <br />forward and he will be happy to address the lighting and signage at tlie next meeting. Mr. Waken <br />suggested that Mrs. Miller was correct when she suggested that people from Fulton Road would be <br />able to afford these apartments. He is concerned about the crime rate going up in their <br />neighborhood and apartments will only bring a lower class resident. Mr. Wilson suggested that the <br />caliber of the apartments have been lowered each meeting and he would ask that the board raise the <br />standard not allow lowering them. <br />Mr. Koeth motioned to send Kennedy Ridge Townhomes parcels 236-17-005 & 015 which consists <br />of 40 new Townhomes with access via Kennedy Ridge Road. To the Board of Zoning Appeals <br />with a recommendation to approve the variances requested on the 1/08/02 write-up. The board <br />would also like the trafF'ic Engineer and Police Department to submit a report for their review. The <br />motion was seconded by S. Asseff and unanimously approved. Motion Carried. Note: In the <br />framing of the motion Mr. Dubelko reminded the board that the developer withdrew his variance <br />request for a ground sign at this time. Mr. Crillespie announced that he would arrive at 7:00 p.m. to <br />meet with the residents and address their concerns. <br />2.
