Mr. Corell said he is not sure that he wants <br />to exempt color. W. O'Malley said the building commissioner is someone not entirely sure that <br />color is something we can control. He might cite the same example Mr. Barker just cited. W. <br />Corell said the commissioner is interested in the quality of the shingle and the manner in which it is <br />laid. He is not concerned with the color. He follows the building codes. The Landmarks <br />Commission has a different set of references which deal with street appeal, architectural integrity, <br />etc. They care about color and that is one of the very things he does not want to dump on the <br />building commissioner's desk because then someone could end up putting a pink roof on a black <br />house, and people will wonder why Landmarks allowed it to happen. It is Landmarks' job to say <br />something about the color. Mr. O'Malley said perhaps there is another issue altogether, which is <br />making the provision of the code clear that color is within Landmark's jurisdiction. It is not right <br />now clear in the opinion of the building commissioner that color is within your jurisdiction and if he <br />does not read it that way, then it needs to be examined. Mr. Corell said at this point because a <br />contractor is doing the work and they pulled a building permit, the board had something to say <br />about color. Mr. O'Malley said that is by accident. Mr. Corell said even so, the board gets the <br />chance move things in the proper direction. Exeinpting it will take away anything the board has to <br />say about it and he for one does not care to give that up. Mr. O'Malley said with regard to the list of <br />exempt activities, in terms of identifying areas for minor changes, maybe we're trying to put a short <br />cut into some areas that need to stay as they are. Mr. Corell said if someone is doing an exact <br />replacement for what is on a home currently, or replacing with what is underneath and originally <br />there, those are no-brainers for the commission. On the other hand, if something is going up that is <br />substantially the same but a different color, they need to talk to the board. Mr. Barker said even if a <br />resident went to replicate back when the home was built, they only had a few colors to choose from <br />back then. A person could replicate style and configuration material to the house but he/she will <br />have an enormous job in picking a color with the variety available. Mr. O'Malley said that Mr. <br />Dailey suggested that the legislative committee. of Council have input on this. Mr. O'Malley <br />reininded him that Council will have the ultimate say in the matter. Mr. Dailey said they can hand <br />this over to Councilman Miller, who is the chairman of the legislative committee, to invite the <br />Landmarks Commission and the building commissioner to a committee meeting to hatch out the <br />details. It would be better than having the matter go back and forth between people. Mr. Barker <br />agreed but said the board needs more time to look over the issue. Mr. Dailey discussed the time <br />frame they have for the next few months. He thinks the building commissioner would be more than <br />happy to come in and sit down with the Landmarks Commission if invited. Once this is put into a <br />form where it can be introduced to Council, it will be sent to the legislative committee and the <br />chairman, if he wants Mr. Conway's direct input, can invite him to that meeting, along with the <br />Landmarks Coinmission. Mrs. Davis said it is important that they, as a group, speak with one voice. <br />Mr. Barker said his suggestion to that would be that the commission needs to discuss these things <br />and finalize their ideas. They need a committee of three to meet with the building commissioner, <br />because if they all meet it will be a five hour meeting. They need to appoint a committee to meet <br />with the building commissioner and then forward it to legislation. Mr. Barker asked Mr. O'Malley <br />if he has a more detailed list of issues from Mr. Conway. Mr. O'Malley indicated he was reading <br />from what he sent to the board and supplementing it with Mr. Conway's comments regarding the <br />driveways and difference between the configuration and materials. Mr. Conway recommended in <br />section (h) that they not get into other similar land surface improvements language where the <br />materials used are of like and similar quality, texture, and color as the original materials. He is <br />saying it is unnecessary language because if it is like and similar material for the driveway and it's <br />in the same place, that it is already exempt somewhere else. It would only trigger an expedited <br />review if we were dealing with a change in location or configuration. Mr. Corell said those are <br />5
