., , <br />CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARD OF ZONING APPEALS <br />MIlNUTES - DECEMBER 4, 2003 <br />I. ROLL CALL: Chairman Maloney called the meeting to order at 7:33 p.m. <br />PRESENT: J. Maloney, W. Kremzar, J. Konold, N. Sergi, and T. Kelly <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Building Commissioner D. Conway, and <br />Assistant Clerk of Commissions A. Kilbane <br />II. REVIIEW AND CORRECTION OF MINUTES: <br />The minutes of the Board of Zoning Appeals meeting held November 6, 2003 have been submitted for <br />approval. , <br />J. Konold made a motion to approve the minutes. The motion was seconded by W. Kremzar and <br />unanimously approved. <br />Chairman Maloney announced that the Ganley proposal has been withdrawn from the agenda at the <br />request of the applicant until further notice. <br />Chairman Maloney reviewed that there are 6 cases requesting 18 variances. The Chairman advised that <br />the board members have viewed the premises involved for each case. Three votes are required for <br />approval. In addition, each case will be judged on the physical situation peculiar to itself, so that in no <br />way is a judgment rendered considered to be a general policy judgment affecting properties and like <br />situations elsewhere. <br />III. BUILDING DEPARTMENT REQUESTS: <br />1). Nancv Whittington, 24232 Woodmere, (WRD 2) <br />Request for variance (1123.12). The proposal consists of a new enclosed patio addition. <br />The following variance is requested: <br />1. A 6 foot variance for rear yard setback (code requires 50 ft., applicant shows 44 ft.). <br />Which is in violation of Ord. 90-125 section (1135.08 (a)). <br />Chairman Maloney called all interested parties forward to review the request. Mrs. Nancy Whittington <br />and the contractor, Ron Borchart, came forward to be sworn in and address the board. Mr. Borchart <br />explained the applicant would like a 12x17 sunroom on the rear of her home. It is a slab home with no <br />basement and she would like the additional storage and floor space. It would be 40 feet from the rear <br />lot line instead of the required 50 feet. He said he would use like materials to match the house, roofing, <br />overhangs and siding. There were no further comments or questions. <br />J. Konold made a motion to grant Nancy Whittington of 24232 Woodmere the request for <br />variance (1123.12), which consists of a new enclosed patio addition and that the following <br />variance be granted: <br />1. A 6 foot variance for rear yard setback (code requires 50 ft., applicant shows 44 ft.). <br />Which is in violation of Ord. 90-125 section (1135.08 (a)). The motion was seconded by T. Kelly <br />and unanimously approved. VARIANCE GRANTED. <br />2). James & Carol Hauer, 4500 Clague Road, (WRD 2) <br />Request for variance (1123.12). The proposal consists of "Not" building a garage for one year. <br />The following variance is requested: <br />1. A variance for location of parking facilities without garage (code requires garage, applicant shows <br />none). NOTE: In a one family dwelling at least one of the parking spaces required shall be provided <br />m a garage. <br />Which is in violation of Ord. 90-125 section (1161.08 (a)(1)).
