1. A 25 foot variance for rear yard requirements/minimum depths (code requires 50 ft., <br />applicant shows 25 ft.). <br />Which is in violation of Ord. 90-125 section (1135.08 (a)). The motion was seconded by W. <br />Kremzar and unanimously approved. VARIANCE GRANTED. <br />4). Stacv & Mark Faddoul, 24086 Carla Lane, (WRD 2) <br />Request for variance (1123.12). The proposal consists of a new 4 foot picket vinyl fence. <br />The following variances are requested: <br />1. An 18 inch variance for fence exceeding height (code permits 30 inches, applicant shows 48 inches). <br />2. A 12 foot variance for fence extending nearer the street line than building set back (code permits 0 <br />ft., applicant shows 12 ft.). <br />3. A 17% variance for 50% of fence open (see note) (code requires 50%, applicant shows 33%) <br />Which is in violation of Ord. 90-125 section (1135.02 (f)(1)). <br />Chairman Maloney called all interested parties forward to review the request. Mr. John Lombardo <br />came forward to be sworn in and address the board on behalf of Mr. & Mrs. Faddoul. He handed out a <br />brochure depicting the proposed fencing to be used. He said the applicants want to provide their small <br />children and dog an ample place to play. They live on the corner lot at Carla and Hawkins. Mr. <br />Maloney said the way the fence is designed, there is a drainage ditch in the back and that is why it is at <br />the angle, from the northwest to the northeast corner. He said they are also showing the fence to be 1 <br />foot off the sidewalk. He would like to see it 3 feet off the sidewalk instead. Mr. Lombardo agreed to <br />that. Mr. Maloney said because of the driveway, where the fence comes out from the house, he would <br />like to see that at a 45 degree angle because if there are children coming down there, it is for the <br />protection of the cars. Mr. Lombardo said he thinks the applicant can live with that. Mrs. Sergi <br />asked if it will be the same height as the fence by the drainage so it will all be in a line. Mr. <br />Lombardo replied it will be, it will all be 4 feet high. There were no further questions or comments. <br />J. Maloney made a motion to grant Stacy and Mark Faddoul, 24086 Carla Lane, the request for <br />variance (1123.12), which consists of a new 4 foot picket vinyl fence and that the following <br />variances be granted as amended: <br />1. An 18 inch variance for fence exceeding height (code permits 30 inches, applicant shows 48 <br />inches). <br />2. A 10 foot variance for fence extending nearer the street line than building set back (code <br />permits 0 ft., applicant shows 10 ft.). There will be 3 feet between the sidewalk and the fence. <br />3. A 17% variance for 50% of fence open (see note) (code requires 50%, applicant shows 33%) <br />4. The fence is to be constructed at the northeast corner of the homeowner's house at a 45- <br />degree angle to within 3 feet of the fence line for safety from the driveway. <br />Which is in violation of Ord. 90-125 section (1135.02 (f)(1)). The motion was seconded by W. <br />Kremzar and unanimously approved. VARIANCES GRANTED AS AMENDED. <br />During the framing of the motion, the Building Commissioner, Mr. David Conway, asked Mr. <br />Maloney if he is asking the applicant to go 3 feet in, in order to kick it out 45 degrees. Mr. Maloney <br />replied that is correct. <br />NOTE: This request is subject to reconsideration at the March 3, 2004 meeting. <br />5). Ganlev Westside VW; 25600 Lorain Road: (WRD 1) <br />Request for variance (1123.12). The proposal consists of a new car sales & service building. <br />The following variances are requested: <br />1. A 4.4 foot-candle variance for illumination levels (code permits 5.0, applicant shows 9.4), section <br />(1161.12 (c)): <br />2. A 169 variance for total parking/storage spaces, (code requires 531, applicant shows 362), section <br />(1165.05 (z)). <br />Which is in violation of Ord. 90-125 section (1161.12 (c)), and (1165.05 (z)).
