CITY OF NORTH OLIVISTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARD OF ZONING APPEALS <br />THURSDAY, NOVEMBER 6, 2003 <br />MINUTES <br />1. ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman J. Maloney, Board members W. Kremzar, N. Sergi, J. Konold, and T. <br />Kelly. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Building Commissioner D. Conway, <br />and Clerk of Commissions D. Rote. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />The Board of Zoning Appeals minutes dated October 2, 2003 have been submitted for approval. <br />J. Konold anotions to approve the September 4, 2003 Board of Zoning Appeals minutes as <br />written. W. Kremzar seconded the motion, which was unanamously approved. <br />Chairman Maloney reviewed that there were five cases requesting nine variances and one special <br />permit. The Chairman advised that the board members have viewed the premises involved for <br />each case. Three votes are required for approval. In addition each case will be judged on the <br />physical situation peculiar to itself, so that in no way is a judgment rendered considered to be a <br />general policy judgment affecting properties and like situations elsewhere. Chairman Maloney <br />announced that at the request of the applicant case #(5), Berg Carwash requested to be tabled <br />until the December meeting. <br />III. BUII_,D1NG DEPARTMENT REQUESTS: <br />1). Ralqh Warnick 26350 Butternut Ridge Road: WRD 4 <br />Request for variance (1123.12). The proposal consists of accessory storage building addition. <br />The following variances are requested: <br />1. A 160 square foot variance for exceeding maximum square footage allowed, (code permits <br />200 sq. ft., applicant shows 360 sq. ft.), section (1135.02 (d) (1)). <br />2. A 2 foot variance for exceeding maximum height allowed, (code permits 12 ft., applicant <br />shows 14 ft.), section 1135.02 (d) (2)). <br />Which is in violation of Ord. 90-125 sections (1135.02 (d) (1)) and (1135.02 (d) (2)). Note the <br />addition & alteration is to the existing workshop, which is attached to the existing detached <br />garage. <br />Chairman Maloney called all interested parties forward to review the request. Mr. Warnick the <br />owner came forward to be sworn in and address the request. Mr. Warnick indicated that his <br />existing garage is 20'x 20' and 14 feet high and has a workshop, 14'x 18' attached which is in <br />bad shape. He would like to demolish the workshop and extend the existing foundation 6-feet <br />back and 18-feet across to have a storage area that will equal the existing garage size. Replacing <br />the workshop and restructuring it will make it esthetically pleasing. Mr. Kremzar questioned <br />what the applicant's intent was for the existing shed. Mr. Warnick suggested that he was not <br />sure but would probably remove the shed once the storage area is done. Mrs. Sergi questioned <br />why the applicant required such a large workshop. Nlr.
