to Mr. Robertson. Mr. Robertson answered "no", he suggested this was putting him in a tough <br />situation as Don was a neighbor and friend. He is concerned what will happen if they sale their <br />home and besides there are things he would like to look into. Mr. Maloney indicated that within <br />North Olmsted there are many homes, which have existing decks in the rear of their yards. <br />Unfortunately do to environmental issues, owners have asked to make three season rooms or <br />enclose their decks. This applicant would like to have a roof so he and his wife can sit outside <br />and ovoid the weathering elements. The variance the applicant is requesting is not that large and <br />it will improve the property value not decrease it. Mr. Robertson indicated that he has other <br />issues and this is not the time or place for them. Mr. Konold questioned if Mr. Robertson <br />agreed with what Mr. Maloney just said. Mr. Robertson answered "yes" from the board's <br />standpoint. There are other issues that he is not prepared to discuss and he was supposed to be at <br />his daughters band boosters meeting but has to be here. He request to have it postponed for three <br />days or a week. Mr. Kremzar indicated that the board only met once a month. Mr. Maloney <br />reminded Mr. Robertson that Mr. Abshire offered not to extend the roof on Mr. Robertson's side <br />of the lot. Mr. Robertson voiced that he did not think that was true. Mr. Kelly questioned if <br />the neighbors concerns were relevant to the variance being requested as the board could only <br />address the 3-foot variance. Mr. Robertson indicated that he came to the meeting to insert his <br />objection because of the way this was handled and basically that is all he is present for tonight. <br />He is not prepared to do much else and one of his questions has been answered. The rest of it is <br />personal and confidential as far as he is concerned and he would rather not discuss it in a public <br />meeting. However, if he could have a few days to ask a couple of questions then he thinks he <br />could be satisfied. Mrs. Sergi questioned if his questions pertained to the variance request. Mr. <br />Robertson answered "yes" it pertains to this whole situation. Board members voiced that they <br />could only address issues pertaining to the variance request nothing more. Mr. Robertson <br />commented that he was supposed to be invited to the meeting and he wasn't fine, it is not <br />important to you. Board members tried to assure Mr. Robertson that it was not intentional that <br />he did not receive his notice by any means. Mr. Robertson remarked that he did not know what <br />it was or whether there is a fix in or not and he really does not care. Mr. Konold voiced that the <br />board members were sorry Mr. Robertson's feelings were hurt. At this point in the meeting, Mr. <br />Maloney had to use his gavel to bring the meeting back to order. Mr. Maloney commented that <br />enough discussion had taken place regarding the request and the board should move on. <br />W. Kremzar motions to grant Donald Abshire of 3096 West 230th Street his request for <br />variance (1123.12), which consists of a new roof over an existing deck and that the <br />following variance be granted: A 3-foot variance for rear yard requirements (minimum <br />depth), (code requires 50 ft., applicant shows 47 ft.). Which is in violation of Ord. 90-125 <br />section (1135.08 (A)). J. Konold seconded the motion, which was unanimously approved. <br />Variance Granted. <br />3). Ronald Mavle 3827 Dover Center Road: WRD 1 <br />Request for variance (1123.12). The proposal consists of a new 16' x 12' shed <br />A special permit to add to a non-conforming building (1165.02). <br />The following variance are requested: <br />1. An 8 foot 8 inch variance for rear yard setback, (code requires 10', applicant shows 1'.4"), <br />section (1135.02 (D) 2). <br />2. A 101 square variance for size of shed, (code permits 91 sq. ft, applicant shows 192 sq. ft.). <br />section (1135.02 (D) 1). <br />Which is in violation of Ord. 90-125 section (1135.02 (D) 1) and (1135.02 (D) 2). <br />3
