J. Konold made a motion to grant Darlene Lutz, 25067 Chase Drive, the request for variance which <br />consists of installing a swimming pool in the backyard and that the following variance be granted: <br />1. A 90 square foot variance for swimming pool, (code allows 86 sq. ft., applicant shows 176 sq. ft.). <br />Which is in violation of Ord. 90-125 section (1135.02 (d)(2)). The motion was seconded by N. Sergi and <br />unanimously approved. Variance Granted. <br />6). Susan & Albert Velikaz, 3673 W. 232 St. WRD 2 <br />Request for variance (1123.12). The proposal consists of a deck around existing pool. <br />The following variance is requested: <br />1. A 194.6 square foot variance for exceeding 20% rear yard coverage, (code permits 640 sq. ft., <br />applicant shows 834.6 sq. ft.). <br />Which is in violation of Ord. 90-125 section (1135.02 (a)(2)). <br />Chairman Maloney called all interested parties forward. Susan and Albert Velikaz came forward to be <br />sworn in and address the request. Mr. Velikaz said they would like a deck around their pool and it would <br />extend 2 feet out. They would put in stairs and a gate to access the deck. Mr. Kremzar indicated there are <br />no dimensions on the submitted plans. Mrs. Sergi said it would be 11 feet from the garage to the pool, and <br />10 feet from the back fence to where the pool is located. Mr. Konold asked how high the deck would be <br />off the ground. Mr. Velikaz said he believes it will be 44 inches. Mr. Maloney asked how far the deck <br />area would be from the house. Mr. Velikaz said that is probably the biggest area in the whole backyard. <br />Mr. Konold asked what kind of gate they intend to have. Mr. Velikaz replied it will be a swinging gate <br />that could be locked. They want it to be harder to access the pool. The fence that goes around the deck <br />will also help. Mr. Kremzar asked if a smaller deck would be acceptable. Mr. Velikaz said he does not <br />know if it would be possible. They are going with what was presented to them. Mr. Kremzar pointed out <br />this is a large variance request. Mrs. Sergi said a variance would have to be added because they would <br />only be 8 feet offthe back line. She asked what the applicant's goal is with the proposal. Mr. Velikaz said <br />it is basically for safety and not really for walking around the pool. They want to enclose the pool better <br />than before. Mrs. Sergi asked if they could consider having the deck and not 2 feet all the way around to <br />eliminate some of the variance. Mrs. Velikaz said that it is hard to say from the drawings they saw. It is <br />hard to say how it will look without the walkway around it. Mr. Maloney mentioned the part in the back <br />of the lounge area. It is 7 feet. He brought up the stairs being about 3 feet wide. Mr. Konold asked about <br />children using the pool. Mr. Velikaz said he has a teenage daughter that uses the pool but there are <br />younger children in the neighborhood and that was part of their concern. Mrs. Sergi asked if they will <br />have a fence at the top. Mr. Velikaz confirmed there would be a fence all around. Mrs. Sergi said it will <br />be 6 feet from the ground to the top. <br />W. Kremzar made a motion to grant Susan & Albert Velikaz, 3673 W. 232 St., their request for variance <br />which consists of a deck around existing pool and that the following variance be granted as amended: <br />1. A 194.6 square foot variance for exceeding 20% rear yard coverage, (code permits 640 sq. ft., <br />applicant shows 834.6 sq. ft.). <br />2. A 2 foot variance for being 8 feet ofFthe rear property line (code requires 10 ft., applicant shows 8 ft.) <br />Which is in violation of Ord. 90-125 section (1135.02 (a)(2)). The motion was seconded by J. Konold. <br />Roll call on the motion: W. Kremzar, N. Sergi, T. Kelly - No, J. Konold and J. Maloney - Yes. Variance <br />Denied. <br />Mr. Kremzar explained that the amount of variance is too great in his opinion. Mr. Konold pointed out the <br />applicant can resubmit plans. Mr. Rymarczyk said if they intend to come back within a year, they will <br />have to reduce the request by 25%. Otherwise, they have to wait a year. Mr. Velikaz asked if there is a <br />problem with where the deck is in the yard. Mrs. Sergi explained she has a problem with the 2 feet going <br />all the way around. She said if that were gone, or smaller, it would alleviate the concern. It is a good idea <br />to have it that high but if that is what they already have, there is no hardship. <br />4
