from where that is, probably more than that. Mrs. Tymkewicz said her only concern was about <br />drainage. Mr. Burke said they are putting in their own sewers. He said Mrs. Tymkewicz has a drain in <br />the back corner of her yard that goes out to Michael Dr. He said her yard is 4 ft. below his yard. He <br />added that the City came out a few years back because of a flooding problem and they leveled out <br />those backyards on Michael and made those yards 4 ft. below the yards on Georgette. As far as any <br />water run-off, his yard will stay level and they have the sewer line. They have the sewer line for the <br />gutter of the house on the south side and they will have the sewer line in the middle of the extended <br />driveway they are going to build, and also a line for the 2 gutters for the garage. Two lines will go out <br />and meet one line and go to the existing gutter drain on the house now. Mr. Maloney asked if he will <br />have those plans presented to the Engineering Department for approval. Mr. Burke replied yes, when <br />he gets the electrical. They already bought the garage and when he gets it all drawn up he will bring <br />the plans up. He said he has to show Engineering the electrical and the plumbing, the sewer line. Mr. <br />Maloney said if the board approves this they can also have it conditioned on the approval of the <br />Engineering Department for the drainage. Mr. Burke said there will be no added build up in the back <br />20 ft. of the property. The garage is where the slab is located and has to be dug out, but it will be the <br />same level as it is now. He took trees out and used a lot of dirt from the north side of his lot to fill in <br />the holes. He is going to put that dirt back and level it out. Mrs. Burke referred to the photos and <br />pointed out neighboring yards. She said they want to stay in continuity with the neighbor's garages. <br />Mr. Maloney said if the shed doesn't make it, then it's not going to be there. Mr. Kremzar asked if they <br />have the right to put up another one. Mr. Maloney said no, if the first shed is dismantled and they will <br />put up a new shed, they would have to file for a permit. Mr. Burke said they are just going to move it. <br />Mr. Maloney said they can move it but if it falls apart, it's gone. <br />J. Maloney made a motion to grant Steve and Diane Burke, 4689 Georgette Ave., their request for <br />variances, which consists of adding a new garage, and that the following variances be granted with the <br />amended condition that the Engineering Department approve drainage for the garage. <br />1. A 5 foot variance for rear yard lot line (new garage) (code requires 10 feet, applicant shows 5 feet), <br />section (1135.02). <br />2. A 5 foot variance for rear yard lot line (relocate existing shed) (code requires 10 feet, applicant <br />shows 5 feet), section (1135.02) <br />3. A variance for no garage until 7/31/03 (code requires 1, applicant shows 0), section (1161.08 <br />(a)(1)). <br />4. A 5 foot variance to have a drive in a side yard which is less than 15 feet (code requires 15 feet, <br />applicant shows 10 feet), section (1135.07 (a)). <br />Which is in violation of Ord. 90-125 sections (1135.02), (1161.08 (a)(1)), and (1135.07 (a)). The <br />motion was seconded by J. Konold and unnnimously approved. Variances Granted as Amended. <br />2). Blockbuster, 26636 Brookpark Road Ext., WRD - 1 <br />Request for variance (1123.12). The proposal consists of new signs. <br />The following variances are requested: <br />l. A variance for 2 wall signs on a unit (code permits 1, applicant shows 2), section (1163.27 (a)). <br />2. An 89.36 square foot variance for more signage on a unit than code permits (code permits 88 <br />square feet, applicant shows 177.36 square feet), section (1163.24 (c)). <br />3. A 380.03 square foot variance for more signage on a building than code permits (code permits 353 <br />square feet, applicant shows 733.03), section (1163.24 (b)). <br />Note: Applicant's total is inclusive of all existing signs already permitted on building. <br />Which is in violation of Ord. 90-125 section (1163.27 (a)), (1163.24 (c)), and (1163.24 (b)). <br />Chairman Maloney called all interested parties forward to review the request. Mr. Robert Casto of <br />Boyer Signs, and Patrick Ryan of Kieffer & Co., came forward and were sworn in. Mr. Casto <br />indicated he is representing Boyer Signs & Graphics.
