<br />Zergott suggested that the goal is to lesson the impact of parked cars on the resident side of <br />the site. He would like to see pine or spruce trees used on the site however no white pine <br />should be used. He would like the main drives improved upon as far as landscaping. <br />Residents Comments and concerns: . <br />Mr. Smith questioned if the building would be a restaurant or not because the plans show a <br />future sandwich area. Mr. Vayda suggested that he did not know what the future held but <br />they are more coffee shop driven. Ms. Sturgeon voiced that the residents are concerned <br />whether the building is a restaurant or not. Mr. Dalpiaz suggested that the building is not a <br />restaurant. Ms. Sturgeon questioned if the fence would be 8-foot high the entire length of the <br />south side of the lot and landscaping firiished that was never completed. Mr. Conway <br />advised that the Planning Commission would have to address fence heights. Mrs. Bowman <br />questioned if there could be something done with landscaping to make sure that the car lights <br />and sign lights do not continue to shine into her front room windows. Mr. Conway suggested <br />that the board members asked for the landscaping to be expanded at the entrances to increase <br />the residents buffering. Mr. Bowman advised the board that when CVS was built they were <br />assured that there would be mounds and landscaping to buffer their home from the lights. <br />Even without this lot being developed the ground sign already lights up his living room. Each <br />of the residents present voiced a concern as to whether the building would be a restaurant or <br />not. Mr. Conway indicated that he would request something in writing from the applicants <br />regarding the scope of the business and have the Law Department review it. He advised the <br />residents that even if it is a restaurant it is allowed however, it could affect whether variances <br />are required or not. Mr. Bowman Jr. questioned if there would be yard lights on the site. <br />Mr. Vayda indicated that there would be yard lights and there will be zero readings at the lot <br />line, as code requires. Mr. Crook reviewed that although the readings will be zero at the lot <br />line and the light poles are only 13 feet high the neighbors will still see light and even with <br />shields which they will have there will be glare. Mr. Conway inquired what type of lights <br />would be used and what the foot-candles are designed for. Ms. Caserta was not sure but <br />indicated she would have the information for Planning Commission. Mr. Zergott reviewed <br />that three of the light poles on the south side are 13-feet high and the remaining light poles are <br />20-feet high, which is allowed. Discussion regarding pole light height versus building height <br />and Planning Commission reyiewing how the building can be used to block the lights from the <br />neighboring residents. Mrs. Smith questioned the ground sign and if there are restrictions <br />regarding how much light could shine off the ground sign. Discussion again turned to <br />whether or not the applicants' building is a restaurant or not. Mr. Conway reiterated that the <br />applicants would have to put in writing what the use of the building is and kitchen equipment <br />was not a factor in determiriing if it is a restaurant. It is what they do inside the facility, which <br />will be put in writing for the Law Department. If the facility is not a service and is in fact a <br />sit-down restaurant then the City will address other issues. Mr. -Bowman Jr. suggested that <br />the exiting apron was not to code and there was never a variance granted. Mr. Conway <br />advised that the Engineering department would have to be asked whether or not the curb cut <br />was to code. <br />J. Crook motion that the building elevations be modified such that the merlot brick is at <br />the taller pylon elements and it replaces the horizontal banding on the north and south <br />side of the last three bays. The striped awning will only accrue at the south and north <br />pylon, the two awnings over the south and west windows will be the merlot color. The <br />rest of the building will remain the two different colored brown brick as called out. The <br />cornice will be around all four sides of the building. The landscaping will be revised to <br />show the different parking pattern, more evergreen elements on both the north and <br />south side of the lot. The. dumpster is to be moved to the north east corner of the site. <br />9 ?
