to the detrimental affect, the board will be hard-pressed to deny a permit, or come up with any other <br />suggestions in concert with Mr. Halleen as to what may or may not be alternative uses to the property or <br />alternative solutions to his request. He suggested they continue the discussion on the very specific point <br />of detriment to the city and the district. Mr. Lang asked if there was any other discussion of the motion <br />to table. Mrs. Lord said that in reading through the review process, they appear to have sixty days after <br />receiving the copy of application for the building permit. She said her question is if they sit for sixty <br />days and C&C Realty chooses not to come forward, she views this as the board still has to act. Mr. <br />O'Malley said he would agree they have sixty days from the date of application to reach the point where <br />they are making a determination as to the detrimental affect. Mr. Lang asked if it is conceivable to wait <br />until the August 11 ineeting to see if the representatives from C&C Realty, a.k.a. Halleen, appear to <br />make a case against a detriinental affect and then upon the conclusion of their presentation, the board <br />makes a finding within a day based on the board's conclusion that it may indeed have a detrimental <br />affect to justify the denial of the permit. Mr. O'Malley said that is correct. Mr. Barker pointed out they <br />have a stack of paperwork on previous meetings involving N1r. Halleen. He said they are spending an <br />hour discussing this and he then asked what is to prevent Mr. Halleen from taking a wrecking ball to the <br />buildings. Mr. O'Malley said people take action without getting the proper permits, and they saw that <br />tonight. He said the Building Department can take steps to stop the work. In theory, something like <br />that can happen but he does not think it will. He has had discussion with the applicant's attorney who <br />expressed an interest in sitting down with the Building Commissioner, Engineer, and a few other people <br />to discuss what can be done. His client is not interested in waiting six months before he can proceed <br />with the plans they have designed. He is looking for suggestions. Mr. Corell suggested they show up <br />and talk with the board. Mr. O'Malley said the board should not consider it as a signal that the applicant <br />did not want to discuss it. Mr. Barker asked if there is anything to prevent members of the commission <br />from meeting to come up with a list of why it would be a detriment to the city. He asked.if they have to <br />have an official meeting to come up with such a list. Mr. O'Malley said they are free to discuss matters <br />among themselves but whatever they want to include, any matters for the record, need to be brought <br />back to a meeting. Mrs. Lord expressed concern about having a quorum in August. Mr. Lang pointed <br />out a resident is scheduled to come before the board in August. There was discussion about availability <br />for the next meeting and it appears there will be a quorum for the August meeting. Mr. Barker said that <br />because of the importance of this matter, he would like to see either Mr. O'Malley or W. Dubelko at the <br />August meeting. Mr. O'Malley said the Law Department is at the disposal of the board. Mrs. <br />VanAuken suggested the board members look into as much information as possible regarding the <br />history of the buildings in question and make the community aware of it and show why they are worth <br />savings. She said a lot of people that live here know very little about the history of the city. Mr. Lang <br />asked if there was any more discussion on the motion to table. P. Barker seconded the motion to table <br />the requests for Halleen KIA. Roll call on the motion: L. VanAuken, P. Barker, T. Dubowski, G. <br />Corell, B. Lord, M. Davis - Yes, and J. Lang - No. Motion to table carried. <br />Mrs. Lord asked if there is anything they can do or should do to reissue the invitation for the next <br />meeting. W. O'Malley said they can instruct the clerk to send a copy of the minutes to the applicant so <br />he knows what the board's concerns are and what the function of the board is. Mrs. Lord said she would <br />recoinmend that Mrs. Kilbane send a letter to the applicant indicating the scheduled time on August 11 <br />and send a copy of the minutes once they have been reviewed. Mr. Barker said he would strongly <br />suggest that an invitation be sent quickly. <br />B. Lord made a motion to have the Assistant Clerk of Commissions send a letter to the <br />representatives of the Halleen KIA dealership who is making a request for a demolition permit to <br />appear at the August llth Landmarks Commission meeting to be held in Old Tovan Hall at 7:00 <br />p.me The motion was seeonded by G. Corell and unanimously approved.
