Mr. Koeth voiced that Planning Commission strongly <br />recommends the applicant work with the new City Planner. <br />2. ]Dunkin I)onuts/ Baskin Robbins; PP# 237-09-005 (Clauge Road: (WRD 2) <br />Proposal consists of construction of a new Dunkin Donuts/ Baskin Robbins Retail building. <br />Note: The Architectural Review Board addressed the proposal on 11-19-03. <br />Chairman Koeth called all interested parties forward to review the proposal. Mr. Vayda, with <br />Retail Architecture, Mr. Dalpiaz, the Construction Manager and Ms. Caserta, also with Retail <br />Architecture came forward to review the proposal. <br />Developers proposal: <br />1Vgr. Vaycla reviewed that they were before the Architectural Review Board and received comments <br />to improve the site and those comments are reflected on the new plans before the board currently. <br />There was quite a bit of discussion as to whether or not the facility is a restaurant or retail store. A <br />letter was presented that day to the City Planner and the Building Commissioner addressing their <br />opinion as to whether or not they are a restaurant. This building will house Dunkin Donuts, which <br />will serve donuts, coffee and Baskin Robbins ice cream. Mr. Dalpiaz indicated that the store <br />would be a 24 hour operation 7-days a week. Mr. Koeth questioned what would be sold at the <br />store. 1dIr. Dalpiaz reviewed that donuts, coffee products hot & cold, different types of tea, bottled <br />beverages, muffins, croissant, ice cream and ice cream products. Mrs. Hoff-Smith questioned if <br />everything was pre-packaged or were items made at the site. Mr. Dalpiaz reviewed that they make <br />ice cream sundaes, floats those types of things. Mr. Rymarczyk indicated that the Building <br />department does not consider this facility to be a restaurant it is a retail store. Mr. O'Malley <br />advised that the City code does not provide a definition for a restaurant so they are hard pressed to <br />attempt to restrict the use of the property as proposed. The permitted use within the code allows the <br />sale of baked goods, beverages, and the selling and services of beverages within a closed facility. <br />The things the applicants are proposing are permitted by the code and as such the City is not armed <br />with a definition which would restrain the use of the property. Mr. Yager reviewed that under the <br />Ohio State code they allow this type of facility to be a retail store. Discussion regarding inside <br />seating and parking space ratio to inside seating took place. Further discussion regarding whether <br />or not the establishment is a restaurant took place. 1V'Ir. Hreha questioned if the applicants intend to <br />sell sandwiches. Mr. Dalpiaz reviewed that they sell donuts, croissants, and bagels. There are no <br />grills, fryers or overhead hoods, no reservations, or waitresses. It is a retail experience nothing is <br />made to order. The donuts are made off site and delivered to the site. He suggested that Dunkin <br />Donuts/ Baskin Robins wants to be active participants within the community. They work with clubs <br />so they can purchase products at a discounted price so they can sale and keep the profits for their <br />cause. There is a marketing department, which works with community leaders as well as with the <br />econoinic development person. Local franchisees try to talk to the local community groups. There <br />is an opportunity to have outdoor seating in the front of the store and they may add that if it is <br />allowed. There are two egresses along Clauge Road and two on Lorain Road as they have a cross <br />easement with CVS Pharmacy. Ir'Is. Caserta reviewed the Architectural Review Boards requested <br />changes for the Commissioners. <br />Board members comments and questions: <br />1bIrs. Hoff-Smith strongly recommended that instead of having a speaker for the drive-through <br />window they remove any speakers and just have the car pull up to the window and make the order <br />as nothing has to be cooked or prepared. Mr. Yager reviewed that the plans in his packet were <br />from Jeffrey A. Scott Architects in Farmington Michigan. The plans he was just provided looks <br />like the exact building and materials just slight changes and they are from Retail Architectures Inc, <br />which in the Architectural world that is a real problem. 1VIs.
