CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE!" <br />PLANNING COMMISSION <br />MINUTES - OCTOBER 28, 2003 <br />IN COUNCIL CHAMBERS <br />7:30 P.M. <br />I. ROLL CALL: <br />Chairman Koeth called the meeting to order at 7:45 p.m. <br />PRESENT: Chairman R. Koeth, Board members S. Hoff-Smith, J. Lasko, W. Spalding, M. Yager, <br />and T. Hreha. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Assistant Building Commissioner T. <br />Rymarczyk and Clerk of Commissions D. Rote. <br />ABSENT: Board member C. Allan <br />II. REVIEW AND CORRECTION OF MINUTES: <br />The Planning Commission minutes dated October 14, 2003 have been submitted for approval. <br />R. Koeth motion to approve the October 14, 2003 Planning Commission minutes as written. <br />W. Spalding seconded the motion, which was unanimously approved. <br />III. BUII.,DING DEPARTMENT REQUESTS: <br />The Home Depot; 26241 Brookpark Road: <br />Proposal consists of the Building Zoning and Development Committee 'sending this matter back <br />to the Planning Commission for judgement of miss-notification of Country Club Condominium <br />residents and further review. Note: Planning Commission approved this proposal 6/24/03. <br />Planning Commission tabled Home Depot 9/9/03. <br />Chairman Koeth called all interested parties forward to review the proposal. Mr. Collins, the <br />Store Manager of Home Depot came forward to address the board. <br />Applicants comments: <br />Mr. Collins reviewed that they had met with the residents a week earlier and the residents <br />misunderstood what was being done. They believed that the building was being expanded not <br />just the fence. The largest complaint was regarding the mounds, which are not owned by"Home <br />Depot, and the owner had a representative present and agreed to work with the residents to <br />address the mounds. Mr. Koeth asked for audience and condominium owners to come forward. <br />Note no representatives from the condominiums were present. <br />Board Members comments: <br />Mr. Koeth indicated that the proposal would return to Building Zoning and Development in <br />accordance to the approval that was made 7une 24, 2003. He apologized to Home Depot for <br />everyone's miscommunications and commented that Home Depot did a good deed meeting with <br />the residents. Mrs. Hoff-Smith indicated that Home Depot was not supposed to have any <br />merchandise for sale in the front of the building. Driving by she has seen many items for sale and <br />witnessed a pedestrian having to walk into the street to get around the merchandise. Mr. Collins <br />suggested that he was under the impression that they were allowed to have merchandise along the <br />sidewalks as long as it is behind the yellow line. Mr. Koeth reviewed that ever since _Home <br />Depot was constructed the City has been concerned about outside sales. This commission does <br />not want to see any merchandise outside the building. The City is concerned for the safety of the <br />store as well as the patrons.
