' R. Koeth macle a motion to approve the Cingular proposal with the recommendation that a <br />fence similar to the one at Clague Road be erected and that arborvitae go around the entire <br />fenced area and be at least 6 feet in height. It vvill also go arounci the front of the site facing <br />Lorain RoacD. The proposal will go to the Board of Zoning Appeals with a recommendation to <br />grant the 3 variances. The motion was seconded by W. Spalding. Roll call on the motion: C. <br />A111n - No, with the comment that this is a better location but not the ideal sate; J. Lasko, W. <br />Spalding, S. Hoff Smith,lVI. Yager, and R. Koeth -Yes. Mr. Yager commented he agreed with <br />Mr. Allan but would still vote yes. 1VIr. Spalding said he appreciates the effort of Cingular to <br />accommodate the residential problems with the previously proposed site. Mre Koeth said he is <br />pleased they are taking advantage of towers that are already there. MOTION CARRIED. <br />Mr. Rymarczyk asked if the proposal will proceed to the Architectural Review Board. Chairman <br />Koeth, after conferring with the board, indicated it will not. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />Lot Split Plat 25001 / 25061 Countrv Club Boulevard <br />The proposal is to split Permanent Parcel Number 236-13-015 (3.4392 acres) into two parcels. The <br />west parcel (Chili's Restaurant) will be 1.9107 acres, and the east parcel (Macaroni Grill Restaurant) <br />will be 1.5285 acres. The location is on the south side of Country Club Boulevard, east of Great <br />Northern Boulevard and north of Interstate 1480. Zoning is Mixed Use District "A". The existing <br />parcel conforms to the area requirements of the zoning code. The proposed parcels will conform to <br />the requirements of the zoning code. The parcels will no longer be a single entity. For future <br />development, a twenty-five foot landscaped area would be needed between buildings according to <br />Section 1149.04 (c) of the zoning code which states, "Such buildings shall have a minimum twenty- <br />five feet of landscaped area between all boundary lines, other buildings, public streets, private streets <br />and drives". <br />Applicant's Presentatioal: <br />Mr. Jason Thigpen came forward on behalf of Bock & Clark Corporation. He said they performed <br />the survey for Brinker Ohio Incorporated. He explained that Brinker owns both restaurants on the <br />parcel and it is preparing to transfer three Chili's restaurants in the state of Ohio to Strang Hospitality <br />Entertainment. In order to do that the property must be split into two parcels so they may retain <br />ownership of the Macaroni Grill. <br />Board Member Questions and Comments <br />Mr. Koeth asked for clarification on the requirement for a 25-foot landscaped area. He commented <br />there is grass in between the two restaurants now but there is not 25 feet. He asked if that is <br />something that will have to be considered the next time they decide to put up a different business. <br />Mr. O'Malley said he thinks that is referring to the sidelines between the buildings. He said the newly <br />created lot line would separate the two buildings in the event that each of these parcels were <br />subsequently redeveloped, they would be treated as a new development and have to comply with that <br />landscape buffering around the perimeter. He said the way it is laid out now, may present some <br />difficulty in the way the parking lot is set up. Mr. Yager asked if with the lot split, both buildings <br />individually would meet all the requirements of the building and zoning codes. Mr. Koeth indicated <br />that was correct. Mr. Spalding asked if there is a joint driveway easement between the two properties. <br />Mr. Thigpen said that is correct. Mr. Spalding asked if Brinker will be the owner of Chili's or the <br />Macaroni Grill. Mr. Thigpen said Brinker Ohio will retain ownership of the Macaroni Grill. Mr. <br />Koeth asked for audience questions. There were none. <br />R. Koeth made a motion to approve the lot split proposal as stated. The motion was seconded <br />by W. Spald'ang and unanimously approved. MOTION CARRIEED. <br />3
