<br />Mr. Hogan questioned if it was their responsibility to contact Home Depot. Mr. Koeth asked the clerk <br />to contact the store manager to find out why they were not present. He requested IV1i-. Hogan leave his <br />contact information with the clerk so she could contact him once she spoke to the Home Depot manager. <br />Mrs. Hoff-Smith suggested different residents and groups have in the past met with applicants outside <br />Planning Commission meetings to sort their concerns out, so Planning Commission does not become the <br />venting ground. Mr. Hogan suggested that the last owner previously met with them when the mounding <br />was done. They would like to meet with Home Depot to work something out. Mr. Koeth again <br />recommended that the association meet with Home Depot before returning to Planning Commission. 1VIs. <br />Petermen indicated that all the residents present will be affected by the expansion. She attended the <br />Building Zoning and Development meeting a few weeks ago and the primary purpose was to let City <br />Council know that Country Club Association was never notified. As well as to discuss issues regarding <br />Home Depot, and all the other stores within the Plaza South. Truck traffic not being policed or regulated <br />was discussed. There are signs posted regarding times and the truck drivers do not pay attention to the <br />signs. The main concern of the expansion is it will create more noise, dirt, dust, traffic, and trucks. The <br />mound is not a sufficient sound barrier it is just a mound of dirt, which has not been maintained. They <br />would rather have a brick wall of some type to deaden the sound. Ms. Weis voiced that she was <br />awakened at 6:30 a.m. by the sound of a truck and as she could not see it, she did not call the police. <br />However, from this point on she will be calling the police each time she hears the trucks. They <br />constantly are hearing the beeping sounds of the trucks backing up. She would like a bigger wall and the <br />dirt mounds should be addressed. She requested the resident's be a priority. <br />Board Members comments: <br />10'Ir. Koeth reviewed that there should be one contact for the homeowners association for the commission <br />to contact. Once that contact is given notice, they are to notify the condominium owners so they can <br />attend the associations meeting with Home Depot. He indicated that Planning Commission has done a <br />good job in notifying the homeowners associations. He would like to request that it be added to the <br />association's bylaws that when new presidents and secretaries are elected they give notice to the Clerk so <br />there is an accurate contact list. Mr. Hogan indicated that the association has had the same office at <br />25561 Country Club Blvd since 1985 so it should not matter whom the president or secretary is to receive <br />proper notification. Mr. Koeth reviewed that notices were sent to Ms. Norton and Ms. Wringenfield at <br />25561 Country Club Blvd. Mr. Hogan indicated that the association meets every week and they met <br />with Councilman Miller because they did not receive any notification. They have received notices for <br />issues that would not effect them at all but not this, which abuts them. Mr. Lasko indicated that the <br />commission would stay here tonight or four weeks from tonight for however long it takes when this <br />comes back on the agenda and listen to all the concerns of the residents first off. However, in defense of <br />the clerk to the best of his knowledge and information and belief the record does indicate that in fact <br />notice was sent to the appropriate address that Mr. Hogan just provided (25561 Country Club Blvd.). So <br />wherever the breakdown of communication accord it is unfortunate and the commission regrets that and <br />agrees what was said earlier that we must move on. Nevertheless, he must stand in defense of the clerk <br />because from what he has seen it appears that appropriate notice was given. Mr. Hogan suggested that <br />he does not question that, although there was not a certified mailing or any signed receipts to prove it. <br />The association would have no reason to say they did not receive notice as they have been before <br />Planning Commission and Council many times for things that effect the association. Mr. Lasko <br />indicated that his point is that the commission is clearly willing to address the concerns as it was <br />returned, but he would prefer that it be caricaturized that it is coming back for further review and not <br />because of any sort of clerical error. Mr. Spalcling indicated that he echoed Mr. I,asko's sentiments as <br />originally when the matter came before Planning Commission they tabled it because of the fact the <br />association was not sent proper notification. The proposal was then rescheduled for the end of June at <br />which time the board was provided indication that notification had been sent to the association. The <br />commission welcomes the resident's appearance to review this. The clerk he is certain tried to do the job <br />3
