CAUCYTS <br />None scheduled <br />II. ROLL CALL <br />Chairman Koeth called the meeting to order at 7:40 p.m. <br />PRESENT: Chairman R. Koeth, Board 1Vlembers; J. Lasko, M. Yager, T. Hreha and W. <br />Spalding. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Planning Director K. Wenger, City <br />r Engineer G. Durbin, Building Commissioner D. Conway and Clerk of Commissions D. Rote. <br />ABSENT: Board members; S. Hoff-Smith and C. Allan. <br />III. REVIEW AND COgtRECTION OF MINUTES: <br />Planning Commission minutes dated Apri127 and May 11, 2004 are submitted for approval. <br />R. Koeth moved to approve the Apri127, 2004, Planning Commission minutes as written. <br />M. Yager seconded the motioa? which was unanimously approved. <br />R. Koeth moved to approve the May 11, 2004, Planning Commission minutes as written. <br />J. Lasko seconded the motion which was unanimously approved. <br />IV. COMlO'IUNICATIONS <br />V. OLD BUSINESS <br />Carnegie Management & Develonment Corqoration, Parcel E: <br />The proposal consists of a Target Store and 3 additional mix use buildings. Note: Structures <br />have relocated since the approved preliminary plan. The Planning Commission approved the <br />preliminary land use on May 27, 2003. Board of Zoning Appeals granted multiple variances <br />on 12/4/04. Planning Commission has addressed the proposal on 9/23/03, 10/28/03, 11/25/03, <br />4/27/04, and 5/11/04. The Architectural Review Board addressed the proposal on 11/19/03 & <br />4/21/04. Additional variances are required. <br />Planning Director's report; Ms. Wenger reviewed that the preliminary plan approval was <br />granted in May of 2003. Since the preliminary approval there have been many changes. Due <br />to the latest modifications which significantly changed the land use of the site the applicant <br />was sent back to Council in accordance with 1149.10 (Amendments to plans for mix-use <br />district). On May 18, 2004 the applicant went before the Building Zoning and Development <br />Committee to request an amendment to their preliminary plans. The Building Zoning and <br />Development Committee and Council approved the amendments which have been referred <br />back to Planning Commission. Therefore Planning Commission is asked to review the <br />detailed plans, and make recommendations to the Board of Zoning Appeals on variances that <br />have been modified or that are new. The following are the major changes to the plans: (1). <br />Buildings B, C, & D the land use has changed to approximately 76% retail, 21% office, and <br />3.5 % community space. Mixed-Use D requires that no more than 50% of the gross floor <br />space be used for retail. Although the Community space is not a permitted use under the
