} <br />known as Mrs. Beaty. The contractor stated they are doing a landscape renovation <br />project including a small waterfall with a stream to be visible from the patio. Mr. Schill <br />-, presented a drawing to the Board showing the proposed pond which will run under the <br />existing deck to a holding basin. The proposed pool sizes will be 6 x 8' and 3 x 4' with <br />roughly 24-30" of water and a stream with approximately 4" of water. The deck will <br />be protected by railings and natural stone. Mr. Engoglia voiced concern for safety of <br />childen. The Board also asked if the water depth can be changed from what is proposed. <br />Mr. Schill said they would require enough water for fish and aquatic plants. The <br />proposed pond will include a step down to a 12" shelf that will run along the entire edge <br />of the pools prior to going down to another level. Mr. Schill said that there are <br />perennials and shrubs that will buffer the sides of _the pool. Eventually the plants will <br />grow up to 24-36" inches. He said there are existing deck posts that will also <br />discourage any accidents from occurring. Mr. Engoglia said that with a barrier like <br />proposed, he does not have a problem with approving this. <br />P. Engoglia moved a motion to approve the installation of a waterfall providing <br />there is landscaping or shrubbery around the two pools that would offer protection <br />to young toddlers. <br />The motion was seconded by M. Conway and was unanimously approved. <br />3. Rockwvnd Development, 4923 Columbia Road: WRD 4 <br />A variance for not fire rating exterior walls, which is in violation of the Ohio Residential <br />Code sections: 302.1 Ezterior walls: Exterior walls located less than 3 feet (914 mm) <br />from property lines shall have not less than a one-hour fire-resistive rating. The fire- <br />resistive rating of exterior walls located less than 3 feet (914 mm) from property lines <br />shall be rated for exposure from both sides. Projections beyond the exterior wall sha11 <br />not extend more than 12 inches (305 mm) into areas where openings are prohibited. <br />302.2 Openings: Openings shall not be permitted in exterior wa11s of dwellings located <br />less than 3 feet (914 mm) from the property line. This distance shall be measured <br />perpendicular to the vertical plane of the wall. <br />Mr. Carsi, contractor and Mr. Stockman, architect came forward. Mr. Stockman said <br />there seems to be a conflict between what the building code and zoning code reads for <br />single family, condominium living and cluster homes. Cluster homes are basically <br />designed on zero lot lines with open space between them. This development has a few <br />cluster homes that have walls with zero lot lines and these are the units in question. <br />According to established codes, the wa11s have to be fire rated, which means no doors or <br />windows. The code requires that walls within three feet of the property line need to be <br />fire rated and cannot have openings. However, due to the common area around the <br />cluster homes, the Board felt there is an exception here. They are looking for a six foot <br />fire separation between two buildings. The code in North Olmsted is to have two or <br />three single family cluster homes together but not four. Anything over four is <br />considered more than a cluster. The open yard area is to remain. The Board asked if the <br />property line could be moved. The architect stated that in order for this to occur, the <br />area would need to be re-platted and re-subdivided. The homeowner's association owns <br />the land. The boundaries are at the walls of the homes. Mr. Corsi reviewed the <br />International Residential Building Code and it has almost the identical requirement, that <br />being three feet from the property line. They do refer to being more concerned with <br />building separation than that of safety. Asst. Building Commissioner T. Rymarczyk <br />agrees with Mr. Corsi and Mr. Stockman and do not want anything to be built in the <br />2
