?- <br />, . <br />. ;- <br />2. Joe & Kerrv Reuic; 23365 Marion Road: <br />Code requires a fence around a"body" of water per section (1345) applicant has a small pond <br />in rear yard. Rear yard is entirely enclosed by a wooden privacy fence, except for driveway <br />entrance. <br />Mr. & Mrs. Repic the owners came forward to address their request. The applicants indicated <br />that the water feature is 2' x 2' and about 6-inches deep. The water feature has a fence on <br />either side of it and the only area of the rear yard that is not fenced is the driveway which is <br />120 feet from the water. Mr. Conway indicated that he had no objections to the request and <br />would like to see the board request legislation to clarify the definition of body of water. <br />M. Conway motion to grant Joe & Kerry Repic of 23365 Marion Road their variance to <br />not fence their body of water which is in violation of section (1345.). N. Althen seconded <br />the motion which was unanimously approved. <br />Mr. Puzzittiello indicated that he would like the clerk to draft a memo to the Mayor requesting <br />a legislative request to clearly or further define the wording "body" of water. The memo is to <br />be Cc: to the Safety Director, Law Director, Building Commissioner and Council. Mr. <br />Conway suggested that the clerk document in the memo the number of requests pertaining to <br />garden ponds the board has had to address. <br />V. ADJOURNMENT: <br />N. Althen motion to adjourn the meeting. M. Conway seconded the motion which was <br />unanimously approved. Meeting adjourned at 5:55 p.m. <br />2
