<br />Which is in violation of Ord. 90-125 sections (1123.12) and (1135.06 A). <br />Note: Existing residence has only a 5' front setback due to irregular lot line. Building permit <br />can not be issued until pending driveway is constructed. <br />Chairman Maloney called all interested parties forward to review the request. Mr. & Mrs. <br />Fiorilli the owners and son Bryan Fourilli each came forward to be sworn in and review the <br />request. The applicant reviewed that after purchasing the home they found out that the <br />home was a non-conforming home as the unusual shape of the lot places the home 5-feet <br />from the property line. It was suggested that O.D.O.T. owns a portion of the front lot which <br />creates the unusual lot shape. The board questioned if the Sterns Road extension affected <br />the applicants property. The applicant believed that the expansion would not affect his <br />parcel. The applicant reviewed that a section of the home would be removed, replaced and a <br />second floor would be added. They will also replace the existing dilapidated deck with a <br />new wrap around deck. The Assistant Building Commissioner requested that if the board <br />granted the variances he would like the following conditions placed on the approval; 1). A <br />temporary gravel driveway be allowed during construction of the addition. However, prior <br />to the issuance of the occupancy permit a hard surface driveway must be installed. 2). Once <br />the occupancy permit is obtained a garage is to be constructed within one year of the <br />occupancy permit date. The applicants agreed to the Building Departments requests. Mr. <br />Rymarczyk advised the applicant that they would have to seek the approval of the <br />Engineering department regarding the apron installation requirements. <br />J. Maloney moved to grant Raymond Fiorilli of 6236 Stearns lZoad his request for <br />variance (1123.12), which consists of an acfdition to an existing residence and that the <br />following variances are granted as aanended; A special permit to add to a non- <br />conforming building, (1165.02). 1). A 50 foot variance for a residence too close to the <br />front property line, (code requires 50 ft. applicant slnows 0'), section (1135.06 A). <br />Which is in violation of Ord. 90-125 sections (1123.12) and (1135.06 A). 'I'he granting <br />of the variances includes a teanporary gravel driveway during the construction of the <br />addition being allowed. The hard surface driveway is to be installed prior to receiving <br />an occupancy permit pending weatteer conditions. Within one (1) year from the <br />issuance of the occupancy permit a garage is to be erected. The curb cut/apron will be <br />subject to the Engineering Departments requirements. W. Kremzar seconded the <br />motion which was unanianously approved. Variances Granted as amended. <br />3. James Carlin; 3955 Lvdgate Drave: (WRD 1) <br />Request for variance (1123.12). Proposal consists of erecting a shed. <br />The following variance is requested: <br />1. A 2 foot 6 inch variance for a shed too close to rear property line, (code requires 10', <br />applicant shows 7.5'). <br />Which is in violation of Ord. 90-125 section (1135.02 (D 4)). <br />Note: Landscaping for play area restricts placement of shed. <br />Chairman Maloney called all interested parties forward to review the request. Mr. & Mrs. <br />Carlin the owners each came forward to be sworn in and review the request. The applicant <br />indicated that as they are a corner lot they would place the 10' x 10' shed on the back of <br />their lot by the existing playground equipment. However they will only be 6'/z feet from the <br />rear yard line. The board reviewed a memo from the Engineering department voicing that <br />the swell must be maintained for proper drainage. Mr. Rymarczyk questioned if the <br />applicant meant 7'/2 feet. The applicant indicated that his application form was wrong the <br />3
