A 47 foot variance for a fence 42 inches high and the <br />remaining 15 feet is to be 30 inches high in the front setback, and the fence is to be <br />50% open and does not require variance item #3. (code permits 0, applicant shows <br />50'), sectiom (1135.02 (F 1)). The fence is to be a picket fence and the building <br />department will give the applicant a copy of the code covering a picket fence. <br />Which is in violation of Ord. 90-125 section (1135.02 (F 1)).W. Kremzar seconded the <br />motion which was unanimously denied. <br />8. Daniel & Sabrina Krull; 26903 Butternut Ridge Road: (WRD 4) <br />Request for variance (1123.12). Proposal consists of installing a swimming pool. <br />The following variances are requested: <br />1. A variance for swimming pool placement, (code requires a dwelling, applicant show <br />none), (see note), section (1135.02). <br />2. A 5 foot variance for placement of swimming pool, (code requires 5' from side yard <br />line, applicant shows 0'), section (1135.02 (D 4)). <br />Which is in violation of Ord. 90-125 sections (1135.02), (1135.02 (D 4)). <br />Note: Approximately 10 feet of 28 feet of pool is being placed on the second lot. <br />Chairman Maloney called all interested parties forward to review the request. Mr. Krull the <br />owner came forward to be sworn in and review the request. The applicant indicated that he <br />made applicant for the pool and found out that his property is two parcels not one so the <br />pool would require a variance. The applicant indicated he was advised that he could <br />consolidate the parcel but found that it would be quit expensive. Mr. O'Malley questioned if <br />the lots were consolidated would the pool meet code requirements. The applicant believed <br />it would meet code requirements. <br />W. A 10 square foot variance for accessory structure in rear yard, (code permits 310 sq. ft, <br />applicant shows 320 sq. ft), section (1135.02 (D 2)). <br />4.
