CITY OF NORTH OLIVISTEI) <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARD OF ZONING APPEALS <br />JUNE 3, 2004 <br />MINUTES <br />I. ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:30 p.m. <br />PIaESENT: Chairman J. Maloney, Board members; N. Sergi, T. Kelly, and W. Kremzar. <br />ALSO PRESENT: Planning Director K. Wenger, Assistant Law Director B. 0'Nlalley, Building <br />Commissioner D. Conway and Clerk of Commissions D. Rote. <br />II. REVIEW ANI) CORRECTION OF MINUTES: <br />The Board of Zoning Appeals minutes dated May 6, 2004 have been submitted for approval. <br />W. Kremzar motion to approve the May 6, 2004 minutes as written. T. Kelly seconded the <br />motion, which was unanirnously approved. <br />Chairman Maloney reviewed that there were 12 cases requesting 29 variances and 1 special permit <br />on the docket. The chairman advised that the board members had viewed the premises involved for <br />each case. Three votes are required for approval. In addition, each case will be judged on the <br />physical situation peculiar to itself, so that in no way is a judgment rendered considered to be a <br />general policy judgment affecting properties and like situations elsewhere. <br />III. BUILDING DEPARTMENT REQiJESTS: <br />Ben Wollenburg; 4343 Root Road: (WRD 1) <br />Request for variance (1123.12). Proposal consists of a gravel driveway. <br />The following variance is requested: <br />1. A variance for adding to an existing gravel driveway extending to a new garage, (code does not <br />permit applicant shows 25' section in front of new garage). <br />Which is in violation of Ord. 90-125 section (1161.11 A). <br />Chairman Maloney called all interested parties forward to be sworn in and review the request. Mr. <br />Peterson the applicant's step-father came forward to be sworn in and review the request. Mr. <br />O'Malley voiced that he was concerned that the Mr. Peterson was neither a contractor, an attorney <br />nor did he have a letter from the owner giving him authority to represent him. He suggested the <br />board table the applicants request until he is present or he submits something in writing giving Mr. <br />Peterson power of attorney to represent him. Mr. Maloney advised that the board would follow Mr. <br />0'1Vlalley's recommendation. <br />W. Kremzar rnotion to table Ben Wollenburg of 4343 Root Road until meeting next. N. Sergi <br />seconded the motion, which was unanimously approved. <br />2. William Scherer; 3169 Clague Road (WRD 2) <br />Request for variance (1123.12). The proposal consists of demo old garage and building new garage. <br />The following variance is requested: <br />1. A 5 foot variance for an accessory structure (garage) to close to rear lot line #1, (code requires <br />10', and applicant shows 5'). <br />Which is in violation of Ord. 90-125 section (1135.02 (C2)). <br />Note. #1. Permit to demo old structure has been issued. <br />Chairman Maloney called all interested parties forward to be sworn in and review the request. Mr. <br />Scherer came forward to be sworn in and review the request. The applicant would like to replace the <br />existing garage with a new larger garage and place it in on the same footprint as the old garage. The
