Chairman Maloney called all interested parties forward to review the request and questioned why the request was changed. Mr. Ware, with the Sign Company came forward to be sworn in and review the request. Mr. Ware indicated that the first drawings submitted were the wrong drawings so he submitted the correct drawings. He reviewed that the sign included their logo (cash advance) and a symbol. Building Commissioner felt the cash advance wording was not needed, as it is not part of the company name. Although code requires the City to be content neutral, he does not see why such a large variance has to be granted when the company name can be placed on a sign within code requirements. Mr. Ware indicated that it is part of a national logo. Building Commissioner agreed that it is a logo and not the name of the company. Assistant Law Director O'Malley advised the board members to address the size of the sign oiily not the content. However, if in fact it is a national logo as the applicant has sug,gested it would help if a copy of the federal trademark was submitted for the records. The board asked what the applicant can live with as their request was to large. Mr. Ware indicated that they could use a 32.11 sq. ft or 14. 03 square foot variance for being over code and submitted an additional packet. The board felt that a 2' x 11' sign or 22 square foot total should be large enough. J.10'Ialoney motion to grant Advance America of (FP# 231-36-008,009,010,011), 25170 Lorain Itoad as amended request for variance (1123.12)., and the following variances are granted: 1). The new wall sign will be 2-feet by 11-feet, and the building department is 4o work out the calculations for the variances. 2). A 213.4 square foot variance for maximum sign face area per lot, (code permits 251.1 sq. ft, applicant slaows 464.4 sq. ft), section (1163.24 (A)). N. Sergi seconded the motion, which was unanimously approved. 13. Fast Track Collec6bles; (PP# 234-03-010), 30771 Lorain Road: (WRD3) Request for variance (1123.12). The proposal consists of ground sign (face replacement). The following variance is requested: 1. A variance for reface a non-confornung pole sign which constitutes a change of use, (code does not permit, applicants shows one. Which is in violation of Ord. 90-125 section (1163.10 0). Notes: 19 Pole sign is 17 feet high, maximum height for a ground sign is 12 feet. 2# Total sign face of sign is 39 square feet, maximum sign face allowable for a ground sign is 50 square feet. 3# Sign face for requested insert is 15 square feet each side. Mr. O'Malley reviewed that the pole sign is grandfathered and the request is for a face change only. This gentleman is a tenant only, he is not in a position to update the building or install a new ground sign that would be up to the owner. Mr. Kremzar voiced that by changing the face of the pole sign it requires the owner to bring the sign down. Mr. O'Malley advised that that was correct. W. A variance for traffic hazards (sign locations) in 35 foot triangle, (code permits none, applicant shows 2 signs), section (1163.17 (A)). 2. A variance for 2 additional ground signs, (code permits 1, applicant shows 3), section (1163.26 (A)). 3. A 50 foot variance for ground signs (spacing), (see note #1), (code requires 200 ft., applicant shows 150 ft.), section (1163.26 (A)). 4.
