CITY OF NORTH AMSTED <br />CIVIL SERVICE COMMISSION <br />NORT14 OLMSTED, 01410 <br />MINUTES - AUGUST 28, 1986 <br />ROLL CALL: <br />The regular meeting of the North Olmsted Civil Service Commission was called to order <br />at 7:55 p.m. by the Chairman. The Secretary called the roll. In'attendance were <br />Mark Musial, Chairman; Robert .Wendt, Commissioner and Pa�a B has, Commissioner. <br />KTso-in-attendance were M—icha_eT Gareau, City Law Director; Carol Ward, Building <br />Department Clerk; Gordon Friedman and Suzanne Nigro, Attorneys for Carol Ward; Court <br />Recorder and Guests. <br />DISPOSITION OF MINUTES: <br />A motion was made by Mrs. Bahas to approve the Minutes of the regular meeting that <br />was held on June 26, 1986, the special meeting that was held on July 3, 1986, the <br />special meeting that was held on July 17, 1986, and the regular meeting that was held <br />on July 24, 1986. The motion was seconded by Mr. Wendt. All those in favor, stated <br />aye. The motion carried and the Minutes were approved as printed. <br />CORRESPONDENCE: <br />Mr. Musial stated that the Correspondence would be reviewed after New Business. <br />NEW BUSINESS: <br />The first item of New Business on the Agenda is a discussion regarding a Hearing for <br />Carol Ward. Mrs. Ward has appealed her transfer from the Senior Center to the Building <br />Department and has requested that the Civil Service Commission hear the appeal. <br />Mr. Gareau opened the discussion with his remarks referring to his Legal Opinion as <br />requested by Civil Service Commission Chairman, Mr. Musial. <br />Mr. Friedman presented his views referring to the Hearing Memorandum that he had given <br />to each'Commissioner prior to this meeting. <br />At this time, the Commission met in an Executive Session to determine if they shall <br />hear the appeal of Mrs. Ward. Mr. Musial called the meeting back to order at 8:50 p.m. <br />Mr. Musial: The Commission has come to the decision that we do not think that a Hearing <br />is entitled by a vote of two to one and we thought we'd state for the record each of our <br />reasons.for voting the way we did. <br />Mr. Gareau: Mr. Chairman, could I request that you put. that in the form of a motion for <br />the record and take a vote on it publicly? <br />Mr. Musial: I move that this action regarding Carol Ward be classified as a reassignment, <br />a non -appealable transfer, and therefore, no Hearing is granted. <br />Mr. Wendt: I second that motion, Mr. Chairman. <br />The Secretary called the roll: Mark Musial, yes; Robert Wendt,`yes; Patricia Bahas, no. <br />
