CIVIL SERVICE MEETING - 4/28/88 <br />Page #3 <br />Next item on agenda was the introduction of Air. Richard Stewart, <br />representing his son, Scott, a member of the U.S. Army and interested in <br />taking the police candidate test in Germany with his commanding officer <br />administering and monitoring same. Mr. Stroh stated he had talked to <br />Mr. Stewart's wife about a week ago and this request had been discussed <br />by the commissioners. The commission had requested the secretary to <br />forward a letter to the Law Director, Gareau, to inquire if the <br />commission could permit a test to be given under the above circumstances <br />in Western Germany. The law director verbally stated that he did not <br />have a legal opinion on the question, it was therefore a discretionary <br />matter for the commission. The commission researched the Rules and <br />there was nothing that governed this situation. Mr. Stroh related that <br />even though Scott had some special circumstances the commission did not <br />want to set a precedent in this situation, furthering this statement <br />with examples. Air. Stroh stated that after he communicated with Mrs. <br />Stewart he had hoped they did not have a misunderstanding about <br />something he said. Mr. Wendt read the statement taken verbally from the <br />law director that if the commission agreed to allow Scott to test in <br />Western Germany then someone would have to be deputized to give the test <br />at the exact same date and time as the one given to polic candidates in <br />North Olmsted, keeping in mind perhaps a six hour time difference. Mr. <br />Wendt stated it was very difficult to grant such a request, stating a <br />few instances. Mr. Stroh, after some discussion, stated that as the <br />Rules did not specifically spell out that he is prohibited from taking <br />this test under the present conditions, and relying on the reliability <br />of the testor, the commanding officer... Mrs. Brookshire inquired from <br />the chairman if he was going to call for a vote or perhaps a caucus. <br />Mr. Stewart was asked to leave the room for a commission caucus. <br />Decision of commission: Stroh voted because the Rule does not speak <br />directly to the issue to allow him to take the test. Commissioners <br />Wendt and Brookshire felt that they would not care to make a precedent <br />in this case and therefore would refrain from allowing the test to take <br />place. <br />Mr. Stewart invited back to hear the decision of the commission. <br />The arrived at decision will become a part of, and incorporated into, <br />the Civil Service Rules & Regulations, that are presently in review. <br />OLD BUSINESS <br />Commission suggested the secretary contact Mr. James Kline of the North <br />Olsmted Schools and request he submit to the commission a copy of the <br />check list used in the testing of the bus mechanic in the Transportation <br />Department. This test was given in-house by the schools and we need to <br />have a copy in the civil service files. <br />(see page 4) <br />
