Chairman Civil Service Commission <br />FROM: James M ;Dubelko ,Asst:_: -Director of La <br />DATE: June 4, 1998 <br />SUBJECT: Proposed Changes to the Civil Service Handbook -- Seniority Points <br />This is in response to your Memorandum of May 20, 1998, requesting input on the <br />issue of whether the Civil Service Commission's Rules and Regulations should be amended to <br />provide differently on the. subject of awarding 'city employees seniority points in promotional <br />examinations for past civil service•''empioyment with other-politieal subdivisions. <br />As you know, on March 11, 1998, the Law Department provided the.Civil Service <br />Commission with a legal opinion that the present Rules and :Regulations of the Commission <br />simply incorporate state law provisions with respect to the subject of awarding Is eniority points <br />in promotional, examinations.. Under state law, 0 civil service employment in any political <br />subdivision of the state qualifies for seniority points in municipal civil `service promotional <br />examinations. <br />In the opinion of the Law Department,, the present rules should be amended. If the <br />object of granting seniority points m promotional examinations is to elevate applicants who, by <br />virtue. of past civil service experience, may be.more qualified for the promotion than other <br />applicants who do not have such experience, then it follows that the past civil service <br />experience which qualifies for seniority points should be relevant to the position for which <br />promotion is sought. <br />Accordingly, it is the recommendation of the Law Department that the Civil Service <br />Commission amend its rules and expressly provide that it the Commission is = following <br />state law with respect to the granting of seniority points in promotional examinations. The <br />Commission should then expressly provide for types or categories of past civil service <br />
