CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE!" <br />CIVIL SERVICE COMMISSION <br />MINUTES — OCTOBER 15, 2001 <br />COUNCILS CONFERENCE ROOM <br />7:00 PM <br />I. ROLL CALL: <br />Chairman, Thomay called the meeting to order at 7:50 p.m. <br />PRESENT: Chairman, J. Thomay and board members L. Zolar and P. Farrell. <br />ALSO PRESENT: Assistant Law Director, J. Dubelko, Fire Chief, Bak and Civil Service Secretary, <br />D. Rote. <br />II. DISPOSITION OF MINUTES: <br />The Civil Service minutes dated September 17, 2001 have been submitted for approval. <br />J. Thomay motioned to, approve the Civil service minutes dated September 17, 2001. The motion <br />was seconded by P. Farrell and unanimously approved. <br />III. REPORTS: <br />There were 9 correspondences received and 2 correspondences sent out for the commissioners to <br />review. <br />J. Thomay motioned to approve the correspondences sent and received as submitted. The motion <br />was seconded by P. Farrell and unanimously approved. <br />IV. OLD BUSINESS: <br />Commissioners need to resume reviewing Fire Candidate Timothy Gates eye exam results and make <br />a motion as to whether or not his name should be removed from the certified list. Note Fire <br />candidate Gates is present to show why he feels his name should not be removed. <br />Mr. Thomay indicated that since the last meeting the Cities doctor sent two additional faxes. One of <br />the Faxes indicates that Dr. Hershner tested Mr. Gates twice and both times failed the eye <br />requirements for North Olmsted. Mr. Thomay read 'allowed the fax from Dr. Hershner dated <br />October 2, 2001. Dr. Hershner suggests that the only reason the two tests are off are due to the <br />calibration of the two machines used. Dr. Hershner suggests that Ohio State University College of <br />Optometry test Mr. Gates for a third opinion. He further suggests that the College be made aware <br />of the issues in question so that they use a system, which does not require calibration. Mr. Thomay <br />indicated that Dr. Hershner believes a third party should test Mr. Gates. This board needs to decide <br />whether they will follow the suggestion of Dr. Hershner. Mr. Farrell commented that he was not <br />sure that the board should require the candidate be tested at Ohio State. However, the candidate <br />could use the opportunity to go to Ohio State and have an eye exam. The board members briefly <br />discussed whether the board should pay for the eye exam if the candidate went to Ohio State. It was <br />determined that at his own cost the candidate should be tested by Ohio State. Mr. Thomay indicated <br />that the board could table the issue until the candidate has the test results back from Ohio State if <br />the Fire Chief has no objections. Fire Chief Bak commented that this has been going on for a long <br />time and he needs to complete the last hire. Mr. Riley remarked that his client received a copy of an <br />eye exam that he took in 1995 and they would like to submit the test results as evidence that he does <br />have 20/20 correctable eye site. (Note: said eye exam results were not submitted) The test was <br />conducted when he first went to work for Amherst Fire Department. Mr. Riley indicated that he <br />understood that the task of the board is to look at all the facts and determine whether Mr. Gates does <br />in fact meet North Olmsted Vision requirements. He believes that they have submitted opinions of <br />three separate doctors which all indicate that Mr. Gates meets North Olmsted's vision requirements. <br />
