regarding the charter given the facts within the WasteWater Treatment plant positions existing. <br />vlHe strongly advised more research be conducted before Mr. Binggeli's question is answered, as it <br />would effect other titles that are not listed as well. Mr. Thomay requested the clerk seek an <br />official request for a legal determination according to the charter. Mrs. Rote questioned how the <br />commission would like the question presented. Mrs. Giesser advised the clerkto include a copy <br />of all the documentation pertaining to the question. Mr. O'Malley advised the clerk to make the <br />question specific exactly what Mr. Binggeli asked. Mrs. Giesser voiced that although we need to <br />answer Mr. Binggeli's question specifically. To make sure the commission is submitting an <br />accurate report to the state each year, the commission should broaden the question to look at other <br />departments and positions. Mr. O'Malley suggested there would be two questions 1) How to <br />respond to Mr. Binggeli's question. 2) Should the Civil Service commission maintain a list of <br />classified positions for future reference, to turn into finance and to report to the Ohio Civil Service <br />State Board. Further discussion as to who is classified and who is not classified, positions created <br />and deleted and what role the Civil Service Commission should have regarding the creation and <br />deletion of positions took place. <br />V. NEW BUSINESS: <br />Review documentation and %z hour video from Firefighter Selection Services: <br />Mr. Thomay indicated that as there are two tapes the commissioners would each take a tape home <br />to view at their leisure along with the documentation that was received with the tapes. <br />Review protest received regarding new testing dates: <br />Mr. Thomay reviewed that the clerk received an e-mail advising that° a testing applicant was <br />filing a protest against the new testing dates as it conflicts with his vacation time. The Chairman <br />indicated that this would not be the time to protest that is normally done after the test is <br />administered. There is a 10 -day period to receive protest once the test results are released. Mr. <br />O'Malley advised that the word protest was being used loosely in this situation, it could be looked <br />at as an objection, request for reconsideration on the date, or to ask the commission to post pone <br />the test again. The commission is correct that the nature of protest under ORC 124.45 and the <br />Civil Service Rules the protest takes place after the test results are released. Mr. Thomay <br />indicated that the commission will treat the e-mail as a request to reschedule the testing dates and <br />the commission will not reschedule the testing dates again. <br />Mr. Thomay indicated that the written test will be July 8, and Oral assessment will be July 15, <br />and questioned if the commission would have to move their July meeting date to accommodate the <br />results being certified. Mrs. Rote felt that the testing company would be able to get the test <br />results to her before the commissions regularly scheduled meeting so it should not have to be <br />adjusted. Discussion regarding the Civil Service having enough funds to administer a Lieutenants <br />test took place. The testing company stated there would be no additional charges for moving the <br />testing dates. The clerk advised that as of August both Police entry and Fire entry list will have <br />expired. <br />VI.
