Continuation of Civil Service addressing Mr. Binggeli's questions and City positions covered by <br />Civil Service including Animal Warden: <br />Mr. Ubaldi said it looks like the closest thing they have to a template is from 1976. It goes through the <br />classified, unclassified and non-competitive positions. Over the years there were some changes but he is <br />not sure how close it sticks with Ohio law, but this may be a good guide. Mr. Thomay asked if there was <br />any documentation that shows the particular positions that were supposed to be classified and <br />unclassified. Mr. Ubaldi then reviewed a list from his packet with the board members. There was some <br />continuation of his question about the unions from what he read took place in 1989. There was a union <br />contract into which a stipulation of the contract was to preclude civil service protection. Mr. Ubaldi read <br />from a section that dealt with the transportation department. In the union contract it read that "all <br />personnel in the city transportation department shall be removed from the civil service list as they have <br />ratified a new contract that will preclude civil service coverage." The supervisors at the time remained <br />on the list. Mr. O'Malley said perhaps that is because they could petition the civil service commission on <br />the employees but could not ask the commission to contradict the charter as to the status of some of the <br />supervisors. He said the civil service commission at that time could have said it does not sound like a <br />good plan, they are not inclined to take them out, we believe the civil service protection and collective <br />bargaining protection can co -exist. Mr. O'Malley said the color coded list that Mr. Ubaldi is looking at <br />was created by the clerk in an effort to try to decipher what has been done and come up with a draft of a <br />list for the commission's review. He said whether or not it is historically accurate is another question. It <br />is an effort to move in the direction of establishing a list. Mrs. Giesser said the other packet they <br />received includes documents gathered thus far so she does not believe they can make a definitive <br />statement right now since there is more information to be gathered. Mr. Ubaldi said in 1991 Mr. <br />Wilamosky ventured something similar to what they are trying to do now. Mrs. Giesser indicated Mr. <br />Wilamosky may have done that when he was the personnel director. Mrs. Kilbane said she believes <br />Mrs. Rote checked with personnel to get everything they have. Mr. O'Malley said his understanding is <br />the clerk checked with the personnel director pursuant to the commissioner's comments about trying to <br />convene meetings to learn more about the positions and duties. This was in an effort to coordinate the <br />matter and thinking that the personnel department might be involved to assist with job descriptions and a <br />better understanding of how the departments are structured and the levels of supervision, etc. Mr. Ubaldi <br />reviewed the report further. Mr. Thomay said they need to do more reading. Mr. Ubaldi he would like <br />them to track down the answers to his two questions: what became of the transportation department bid <br />for union protection and did Mr. Wilamosky ever create a list. Mr. O'Malley said the charter makes it <br />simple but they noticed the last time the great category of unskilled labor is unclassified. In terms of <br />guidance the civil service commission can keep its own counsel as to how to go about defining this <br />unskilled labor pool, never mind the fact that under state law, unskilled laborers are classified. State law <br />does provide some guidance. He agrees that the idea to get a better understanding of the positions is a <br />wise one. Mr. Thomay said they could ask all the department heads to provide them with job <br />descriptions. <br />V.
