Ke <br />to him, or to the people trying to make it in for the test from Toledo. He said they couldn't make the test <br />because of the snow storm. He mentioned again the miscommunication that he believes made the <br />process unfair. There was a brief discussion of when the test was offered and how often the test is <br />administered. Mr. Bowser stated he was hoping for another opportunity to take the test without being <br />taken off the eligibility list. Mr. Hohmann said there was another candidate who approached the <br />Commission about an extension to submit his agility certification due to an injury. The Commission did <br />not grant that request and would, in fact, encounter legal problems because the rankings have been <br />certified. Mrs. Giesser said the way the Civil Service rules are, they do not have an "out" on the issue of <br />sixty days to submit the agility results. They cannot make an exception to the rules. Mr. Bowser said he <br />missed out because of the miscommunication and he will keep pushing the issue. Mrs. Giesser thanked <br />Mr. Bowser for coming in to present his case. Mr. Hohmann reminded Mr. Bowser of the effects on <br />ranking. Mr. Bowser reiterated that things were altered the morning of the exam and he found that <br />unfair. He reviewed his complaints about the test and the timing issues. Mr. O'Malley suggested that <br />the Commission act on Mr. Bowser's request since the agenda had been adjusted and the hearing had <br />actually commenced. <br />R. Giesser made a motion to remove from the eligible list the names of those people who did not, <br />by the due date, submit certificates to the Commission proving they had passed the Tri -C agility <br />test (list attached to the minutes). The motion was seconded by M. Ubaldi and unanimously <br />approved. <br />R. Giesser made a motion to accordingly adjust the eligible list and accept that list as adjusted and <br />the top five names on that list will be sent to the Police Chief. The motion was seconded by W. <br />Hohmann and unanimously approved. <br />Mr. Bowser thanked the Commission and left the meeting. Mrs. Giesser said for the purpose of <br />preparing for the next test, before setting a calendar and before finalizing rules for the next test, they <br />should touch base with Tri -C to see if, in fact, there was only one opportunity to take the test within the <br />sixty day window. They might want to try to adjust the testing next time so there would be more <br />opportunity within the time frame, or adjust the time frame. Mr. Ubaldi said they do need to see how <br />many times the applicants had for testing from the time the advertisement was placed to January 31, <br />2005. Mr. O'Malley said the procedure in place is valid and the use of a validated system through Tri -C <br />is acceptable. There was sufficient notice and opportunity for all of the candidates, before and after the <br />written exam, to obtain their physical agility certification and provide it to the Commission. The record <br />reflects timely correspondence to all candidates and very few candidates filed a request for an extension <br />of time or brought forward any mitigating circumstances. The only person that came forward to be <br />heard, long after the deadline, has cited his personal inability to pass the test. The suggestions being <br />made could be brought up another day or upon another visitation to the rules. He said he does not want <br />the Commission to be uncomfortable with the action that was taken. Mr. Ubaldi said perhaps they <br />should re -visit the sixty day deadline.
