will be any retirements coming up that would result in the hiring of a new patrolman. The Chief <br />responded there will probably not be any retirements this year but he did put the replacement of a <br />patrolman in the budget and that would be effective July 1, 2005. He added he anticipates the possibility <br />of retirements next year which would require promotional exams and. hiring off the present entry level <br />list. There was a discussion about certified lists and the length of time a list is considered current. Mr. <br />Ubaldi said they may need to change language in the book to accommodate the police department and <br />the expectations of the applicants. The certified list would be based on the full composite, rather than a <br />list based on the written exam and a floating requirement like the agility test. The Chief had mentioned <br />that his understanding is a certified list is one that he is capable of hiring from. He said with <br />promotional exams, the certification comes after both the written and the oral assessment. Mr. O'Malley <br />reviewed the efficiency rules for the Fire Department, which is based on a one year record system. He <br />believes Rule 8 is attempting to have the same rule for both police and fire. He then reviewed subsection <br />c and d. Mr. Ubaldi said he believes they talked last month about language that would not hold the <br />appointing authority or the Commission to a time period. He thought they would just look to the most <br />recent evaluation. Mrs. Giesser agreed they did talk about using the most recent evaluation. The Chief <br />indicated using a six month time table would not put an additional burden on the police department. Mr. <br />Ubaldi said they can leave the rule as is. Mr. O'Malley said the Commission was concerned that the <br />department was relying on a lot of the criteria listed in the book as the standard for evaluating for <br />efficiency. There was a brief discussion about factors that result in a low rating, and a discussion of <br />traffic issues. The Chief departed the meeting. The conversation returned to revising the handbook. <br />Mr. Ubaldi said at the last meeting, the Commission combined 8c and 8d (Rule III). There was a lengthy <br />discussion about the changes reviewed at the last meeting and additional changes yet to be made. Mrs. <br />Kilbane expressed concern about the various versions of the handbook in circulation. She recommended <br />working from one copy of the book and also using the editing documents she has sent in the packets. <br />Mrs. Giesser suggested holding off on any revisions to Rule III relating to the firefighter evaluations <br />until they receive a response from the Fire Department. She indicated they can take a look at Rule IV at <br />the next meeting. There was a discussion about how the rule currently reads and its relation to the state <br />code. The rule involves protests and inspection of exam papers. Mr. O'Malley reviewed the rule for <br />filing a protest, and the procedural aspects of filing a protest. Mr. Hohmann suggested that the steps for <br />filing a protest be spelled out in the handbook. Mrs. Giesser said the way the rule reads now, a candidate <br />has the right to protest after he/she receives a test score; the way the state code reads, it is before they get <br />the test score. Mr. Ubaldi said they should be prepared to confront that at the next meeting. Mr. <br />O'Malley said one of the dilemmas was the ten day protest period. A discussion then took place <br />regarding the protest period, how a protest is processed, and the material that is reviewed in a protest. <br />Mrs. Giesser explained a previous protest in which the Commission overrode the testing company on a <br />couple of protested questions. Mr. O'Malley suggested that the Commission adopt and make reference <br />to O.R.C. 124.45 for the purposes of the protest period and then they can supplement it as they <br />discussed. They can address things such as the proper procedure for filing a protest, e.g., "any applicant <br />interested in making an inspection of examination papers shall make an appointment in person with the <br />office of the Civil Service Commission." <br />V.
