RULEXI <br />LAYOFFS <br />The following rules shall apply to all situations or circumstances not covered by the union's <br />collective bargaining agreement. <br />Section 1: Lack of Funds <br />A "lack of funds," for purposes of layoff, means that the appointing authority has a current <br />or projected deficiency of funding to maintain current levels, or to sustain projected levels, <br />of staffing and operations. Determination of such a condition and notification procedure <br />shall be made in accordance with Ohio Revised Code 124.321 (A) and (B). <br />Section 2: Lack of Work <br />A "lack or work", for purposes of layoff, means the appointing authority has a current or <br />projected temporary decrease in the workload, expected to last less than one (1) year, <br />which requires a deduction of current or projected staffing levels. Determination of such a <br />condition and notification procedure shall be made in accordance with Ohio Revised Code <br />124.321 (C). <br />Section 3: Abolishment of Positions <br />"Abolishment of position" means the permanent deletion of a position from the <br />organization or structure of the appointing authority due to lack of continued need for the <br />position. Conditions under which abolishment can occur, notification procedures and <br />reduction in work force provisions shall be in accordance with Ohio Revised Code 124.321 <br />(D) and (E). <br />Section 4: Layoff Procedures <br />Determination as to which classification or classifications a layoff or layoffs shall occur in, <br />and the number of layoffs to be made, shall be in accordance with the procedures of Ohio <br />Revised Code 124.322 <br />a. In layoffs, consideration shall be given to employee's length of service and also includes <br />efficiency in service, appointment type, or such other factors deemed appropriate. <br />b. Whenever a reduction in force is necessary within a Civil Service classification, employees <br />shall be laid off in the following order: <br />1. Temporary employees. <br />2. Intermittent employees. <br />3. Part-time employees. <br />4. Seasonal employees. <br />5. Full-time employees. <br />c. Full-time employees should be laid off in the following manner: <br />
