coo <br />A general discussion for Rule XI followed concerning minor changes.' ��aD <br />/r <br />Mr. UWdi made a motion to accept the draft for Rule XI. Mrs. Giesser seconded the motion <br />and unanimously approved. Rule XI is attached to the Civil Service minutes dated November <br />21, 2005. <br />Mrs. Giesser discussed Rule XII. A general discussion followed concerning minor changes to the <br />rule. Mr. O'Malley inquired about the probationary period for Police and Fire. Mrs. Giesser <br />advised she contacted Ed Robertson, the Assistant Fire Chief, and was informed that the <br />probationary period is eighteen (18) months. Mr. Hohmann inquired if that is the same for Police. <br />Mrs. Giesser indicated that she did not contact the Police Department. Mr. O'Malley pointed out <br />that there is a one (1) year probationary period according to the O.R.C. 124.27 sub section c which <br />states "not less than 60 days and no more than one (1) year". A general discussion followed <br />concerning the probationary period, huge situation to change eighteen (18) months to twelve (12) <br />months, to be consistent with State law, and table rule. Mr. O'Malley will research the probationary <br />period and get back to the Commission. <br />Mrs. Giesser made a motion to accept the draft to Rule XII as proposed, complete through the <br />new language in Section 8. Mr. Ubaldi seconded the motion and unanimously approved. Rule <br />XII is attached to the Civil Service minutes dated November 21, 2005. <br />Mrs. Giesser discussed her changes on her proposed draft for Rule XIII. A general discussion <br />followed concerning filing an appeal. <br />Mrs. Giesser made a motion to adopt Rule XIH as proposed. Mr. Hohmann seconded the <br />motion and unanimously approved. Rule XIII is attached to the Civil Service minutes dated <br />November 21, 2005. <br />Mrs. Giesser inquired to Mrs. Eccleston if Ms. Farver had any comments concerning Rule XIV, <br />Archives -Active Files. Ms. Farver approached Mr. O'Malley and he indicated he will discuss this <br />matter with the Commission. A general discussion followed concerning Ohio Public Records Law, <br />fine for destroyed records without authority from the Records Retention Commission, and inventory <br />of records. Mr. O'Malley indicated that the Northeastern Ohio Civil Service Commission <br />Association and the Ohio State Historical Society may have some guidance on a model for records <br />retention. If the rule is changed to refer to the Records Retention Commission, the Civil Service <br />secretary will not have a procedure on how the records should be kept. Mr. O'Malley will look into <br />this matter further. <br />Mrs. Giesser made a motion to delete the whole contents of Rule XIV and adopt the draft <br />proposal. Mr. Ubaldi seconded the motion and unanimously approved. <br />Rule XIV will read as follows: <br />Civil Service Records shall be kept, destroyed and made available for public inspection in copying <br />in accordance with the Ohio Public Records Law. <br />Mrs. Giesser inquired to the Commission if they want to meet in December to discuss the <br />probationary period from Rule XII or wait until the January, 2006 meeting. Mr. Hohmann <br />suggested if that is the only issue, the Commission can wait until the meeting in January. Mr. <br />
