Section 2: remove the article "of the" and add a comma after Sec. 124.25. Section 3 c; remove the phrase "by the applicant." Section 3 f. remove all the text following the first sentence. A general discussion followed regarding the processing fee and the Civil Service budget. The fee was waived for the Emergency Central Dispatcher Examination. Rule VII Section 5: remove the words "Except that" and capitalized "Any"; amend the sentence to read "Any list that has been in existence for more than one (1) year may, at the discretion of the Commission when in the public interest be terminated at any time." A general discussion commenced concerning changing the current five (5) names certified to seven (7) and five (5) times certified to three (3); previous concerns prompted review; to keep the current five (5) naives certified and five (5) times certified; increase pool of viable candidates; ten (10) naives certified per State Law; viable candidates would be eliminated if they were certified three (3) times. The Commission decided to change the certified naives to seven (7) and the number of times certified to three (3). If there becomes a problem with this decision, the Commission will revisit this rule. Rule VIII Section 2 a: the Commission rejected the change. Section 2 b: the Commission also rejected the change because it is redundant. Section 2 c: remove the word "immediately." Rule XIII Section 1, subsection a, subsection 1: remove the quotation marks on the word "file" and add the word considered before the word file; remove the quotation marks on the word "received" and add the word considered in front of the word received for the new language; delete part of the sentence starting with "presented or delivered..." and replace with "received by the Secretary." A general discussion followed concerning how the appeals are received and heard; special meetings. Rule Section 2, subsection a: remove the quotation marks on the word "filed" and add the word considered in front of the word filed. Mr. Ubaldi made a motion that all changes to the Civil Service Rules and Regulations handbook be accepted and applied. After the changes have been made to the handbook, forward copies to the Commission. Ms. Zolar seconded and unanimously approved. A general discussion commenced regarding the amended Rule VIII: the changes to the number of certified candidates and the number of times a candidate may be certified for different vacancies. An inquiry was made if the changes to the number of times a candidate can be certified would be grandfathered and would be applied to the next eligible list created so the Commission does not create some kind of controversy by robbing any candidate on any existing eligible list. The Law Department indicated that eligible lists usually lie there until a vacancy occurs and the rules are forever shifting; there are no grandfather rights. A suggestion was made to handle on an individual basis if this situation arises.
