ROLL CALL: Chairman M. Ubaldi. called the meeting to order at 8:00 p.m. <br />PRESENT: M. Ubaldi, and B. Hohmann <br />ALSO PRESENT: Human Resources Director C. Farver, Public Safety Director L. Thomas, <br />Finance Director C. Copfer, Firefighter T. Kirkpatrick, Assistant Law Director B. O'Malley, Civil <br />Service Secretary D. Eccleston <br />II. DISPOSITION OF MINUTES: <br />V. NEW BUSINESS: <br />Hearing on Appeal, to Commission, of Decision to Lay Off Assistant Fire Chief at the North Fire <br />Department Due to Lack of Funds <br />The Commission will hear the appeal of the layoff of the Assistant Fire Chief for the City of North Olmsted <br />and recognizes the appointing authority, which is the Director of Public Safety for the City of North Olmsted <br />and the [appellant], Todd Kirkpatrick. This hearing will be conducted in accordance with Ohio Rules of <br />Evidence. The procedure will be as follows: the appointing authority carrying the burden of proof will <br />present a rationale for the lay off of the Assistant Fire Chief; the [appellant] will have an opportunity to <br />refute the -arguments presented by the appointing authority; finally, if it so chooses, the appointing authority <br />may respond to any statements made by the [appellant]. Both parties may, according to their discretion, <br />present evidence, call witnesses, make opening and closing arguments. At the conclusion, the Commission <br />will deliberate and depending on the circumstances may have a final decision. <br />The Director of Public Safety for the City of North Olmsted, Lisa Thomas, was sworn in by the court <br />reporter. The City made the determination to go forward with the layoff of the Assistant Fire Chief because <br />of the dire financial situation that the City faces in 2009 and the Safety Director referred to her memo to the <br />Chairman of the Civil Service Commission dated January 12, 2009. The Administration was directed in the <br />early part of 2008 to cut one million dollars out of the budget. The Administration was then <br />forced to cut another million dollars out of the budget. <br />
