Barrett called the meeting to order at 7:03 p.m. <br />PRESENT: J. Barrett and M. Hayes <br />ALSO PRESENT: Human Resources Director C. Farver, Asst. Law Director B. O'Malley, <br />Safety Director D. Glauner, Legal Counsel B. Bryan, Legal Counsel B. <br />Huffman, Fire Lieutenant M. Peters, Firefighter T. Kirkpatrick, Fire <br />Lieutenant D. OLD BUSINESS: <br />Appeal for Promotional Fire Lieutenant Examination <br />Assistant Law Director B. O'Malley discussed the hearing procedures. <br />Legal Counsel for the Firefighter T. Kirkpatrick, Brad Bryan, provided an opening statement that <br />outlined the reasons for the protest regarding how the oral portion of the exam was administered <br />and scored. Discussion commenced regarding scores, ret -testing, weight of examination, and oral <br />assessment panel. <br />First Witness: Todd Kirkpatrick is a Firefighter for the City of North Olmsted. Entered into the <br />record is Exhibit 1, posting for the written examination and oral assessment and the oral <br />assessment schedule. Exhibit 2, ranking list after written test scores, participation letter for oral <br />assessment, final score sheet, Fire Lieutenant promotional ranking list. Exhibit 3, public records <br />request email, Exhibit 4, oral exam grading sheets. Examination and cross examination proceeded. <br />Mr. Bill Huffman, Legal Counsel for the City of North Olmsted, conducted examination and cross <br />examination. <br />B. O'Malley conducted examination and cross examination. <br />B. Bryan conducted examination and cross examination. <br />Second Witness: Dennis Doverspike, contractor for Poly -Tech Testing Company, examination and <br />cross examination proceeded. <br />B. Bryan presented closing argument reiterating the nature of the oral exam scoring and how the <br />exam was not properly weighted. <br />
