BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF AUGUST 5, 2019 <br />ROLL CALL <br />Chairman Raig called the meeting to order at 7:00 pm in Council Chambers and led the Pledge <br />of Allegiance. <br />Present: Mike Raig, Bob Papotto, Ralph Mackey, Eric Allain <br />Absent: Dan Rahm > <br />Staff: Law Director Michael Gareau, Jr., Assistant Building Commissioner Dan Russell, Planner <br />James Aspery, Administrative Assistant Nicole Rambo -Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Allain moved, seconded by Mr. Papotto, to approve the Building & Zoning Board of <br />Appeals minutes of July 1, 2019, motion passed 4-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />19-14222; Salwa Alhaia; 23741 Curtis Drive <br />Representative: Hassan Tamimi, 23741 Curtis Drive <br />Proposal consists of a patio in the front yard. Property is zoned C -One Family Residence. <br />The following variance is requested: <br />1. A variance for a patio in the front yard; code permits accessory structures only in rear yards <br />of residential lots, applicant shows patio in the front yard, Section 1135.02(C)(1). <br />Mr. Aspery stated that the applicant is seeking to install a new patio extending off the front of <br />their home. A patio is classified as an accessory structure under the code, which are prohibited in <br />the front yard of homes in One or Two Family Residence Districts. Mr. Tamimi stated that the <br />concrete pad is proposed under the bay window because he has not had success with plantings in <br />the area. The previous paver patio he installed needs to be cleaned regularly and he would prefer <br />to have concrete. Mr. Aspery said the proposal presents several additional zoning code issues. If <br />approved in the front yard, the requirement of a five foot setback from the side lot line is still <br />valid. Code also requires any decks or patios attached to or contiguous to the structure to meet <br />the required building setback. In this case, the front setback is already at an existing non- <br />conforming distance, so the addition of a patio in the required yard would make the situation <br />further non -conforming. Given these considerations, the Planning Department objects to this <br />request. <br />Mr. Mackey asked if the patio can be installed in the back yard, Mr. Tamimi said there is an <br />existing concrete pad in the back yard. Mr. Tamimi said he will sit on the front patio <br />occasionally but furniture will not be left there year-round. Mr. Mackey asked if any other <br />improvements would be made to the pad, such as a pergola, and Mr. Tamimi said no. Mr. <br />Papotto asked for dimensions of the pad, Mr. Tamimi submitted pictures showing the <br />dimensions. Mr. Raig asked if Mr. Aspery knew the distance from the front of the house to the <br />
