BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF MAY 4, 2020 <br />ROLL CALL <br />Chairman Allain called the meeting to order at 7:03 pm via online public meeting. <br />Present: Eric Allain, Bob Papotto, Suzie Patton, Dan Rahm, Ralph Mackey (arrived during <br />Simoncic discussion) <br />Staff: Law Director Michael Gareau, Jr, Planning Director Kim Lieber, Assistant Building <br />Commissioner Dan Russell, Administrative Assistant Nicole Rambo -Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Ms. Patton, to approve the Building & Zoning Board of <br />Appeals minutes of March 2, 2020, motion passed 4-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />20-16092; Jason Wood; 5590 Pheasants Walk Drive <br />Representatives: Jason Wood, owner <br />Proposal consists of a fence on a corner lot. Property is zoned B -One Family Residence. <br />The following variance is requested: <br />1. A 13 ft. variance (approximate) for setback of a fence constructed on a corner lot in the side <br />and rear yards abutting a side street (Wood Path Drive); code requires 20 ft.; applicant <br />provides approximately 7 ft.; Section 1135.02(D)(3). <br />Ms. Lieber said the applicant proposes to install a six-foot vinyl fence in the side yard of their <br />corner lot. A 20 -foot setback for a fence of this height is required, the applicant shows a setback <br />of approximately seven feet at the closest point to the ROW. The fence jogs in toward the rear <br />yard. Mr. Wood said they moved into the home in November. There is not a stop sign at the <br />intersection and he is concerned about the safety of his family. He would like to maximize the <br />backyard space by including the side yard inside the fenced area. He did not think the fence <br />would impede work being done on the sidewalk. If not fenced in, the side yard space would not <br />really be utilized. Ms. Lieber confirmed with the applicant that the fence would be seven feet <br />from the sidewalk, not the curb. Ms. Lieber looked at the parcel boundaries, since it is an odd <br />shaped lot. The fence is proposed to end at the rear yard line. As the fence is proposed in an <br />easement, the city engineer has requested a gate be installed at the northwest corner of the <br />property, which is shown on the plans. She pointed out that there is no neighboring driveway <br />near the proposed fence and there is existing vegetation near the sidewalk so the fence should not <br />affect visibility. <br />Mr. Papotto asked where the fence would be relative to the neighbor's existing wood fence, Mr. <br />Wood said the fence would be slightly closer to the sidewalk than the neighbor's. Ms. Patton <br />asked how far the fence would jut out from the neighboring fence line, Mr. Wood said the jut out <br />would be about three feet wide.
