Air conditioning units and generators need to be installed contiguous to the house but staff <br />wanted to provide more flexibility to residents on where the units can be installed. Currently, if <br />the house is at the minimum rear yard setback, then a variance would be required to install an <br />AC unit behind the house since the units would have to meet the same setback as the house. Staff <br />suggested allowing units to be installed four feet into the side yard with a minimum of a five foot <br />setback for homes that are built on the rear yard setback. If it is installed in the side yard, <br />screening would be required. Generators would not be allowed in the side yard since there are <br />currently no models that could meet the noise ordinance requirements. The noise control chapter <br />is enforced by the Safety Division and needs to be addressed in the future. Staff wanted to be <br />sensitive to the noise created by generators to help protect neighbors but reduce the amount of <br />variances requested for them. Mr. Malone was concerned about potentially creating a hardship <br />for residents whose electrical panel is on side of their home because it would be more expensive <br />to install the generator in the rear yard. Ms. Lieber suggested revisiting the code if the <br />technology improves. Ms. Nader agreed with requiring the generators be installed in the rear <br />yard because they are fairly loud now and the code can be revisited. She thought a condenser is <br />much smaller than a generator and would be less obtrusive if installed in the side yard. Mr. <br />Olivos said there are two types of generators that have different fuel and maintenance <br />requirements, gas and diesel/gasoline. Mr. Olivos was concerned about not having a limit on the <br />size of the generator. Ms. Nader thought odors from the generator could be an additional concern <br />if located in the side yard. <br />Administrative Approvals <br />Ms. Lieber reviewed the recently approved amendments. Millennium Place, 25209 Country Club <br />Boulevard, changed the size and location of their patio. Horizon Education Center, 25300 Lorain <br />Road, changed some of the approved colors and materials. Tire Choice, 4565 Great Northern <br />Boulevard, added new paint to complement their new signage. KFC, 27901 Lorain Road, had <br />approved plans for an exterior remodel which expired and was reapproved. Rite Aid, 29000 <br />Lorain Road, removed awnings. Jamestown Apartments, 4809 Columbia Road, are doing <br />extensive site changes, including concrete work, lighting, landscaping, dumpster enclosures, roof <br />repairs, removal of the swimming pool and tennis courts and utility improvements. Five Guys, <br />26037 Lorain Road, installed a concrete curb to the store front to prevent water issues. Butternut <br />Ridge Apartments, 5800 Great Northern Boulevard, is installing a 16 x 20 shed. Vitalia Senior <br />Living, 29709 Lorain Road, removed a villa and added more space between the driveways to <br />improve the safety of the residents. The City Hall lobby is undergoing COVID-19 related <br />improvements to improve the health and safety of employees and visitors. <br />Shin Code Update <br />The proposed updates has been voted out of the BZD committee and are going to City Council to <br />be voted on. A few recommendations were made by the committee. The digital sign prohibition <br />for landmarked properties was removed but would still apply in the historic district. Digital signs <br />would be prohibited in residentially zoned districts. Vehicle signs would be permitted as time- <br />limited temporary signs and would require permits. A temporary sign policy has been proposed <br />to address additional signage needs for businesses during the pandemic. Hopefully the updated <br />code will be effective by the end of the year. <br />ADJOURNMENT <br />
